He suggested it indicate "carcasses of domestic <br />animals." City Attorney Goodrich stated this has been contained in the City code for at least 30 <br />years. Voting No: None. <br /> <br />Case/ti 1: Consider Adoption of Sale of Fireworks Ordinance Amendments <br /> <br />Director of Public Works/Fire Chief Kapler explained that the 2002 State Legislature made <br />changes to Minnesota Statutes 624.20, which now allows for the public sale for a limited number <br />of consumer fireworks. He noted that the fire department requested some changes to the City <br />Code of ordinances during a Council Meeting of May 28, 2002. During a special session of the <br />City Council of June 4, 2002, the Sales of Fireworks Ordinance amendments were introduced. <br />He stated a copy of the amended draft ordinance was provided to the Council tonight. Director <br />of Public Works/Fire Chief Kapler reviewed the revisions that were made at the Council's <br />direction. <br /> <br />City Attorney Goodrich stated there are a minority of city attorneys that are treating this less than <br />others. He read a statement from the Minnetonka City Attorney indicating there is sufficient <br />regulations and recommending Minnetonka not adopt further ordinances to regulate fireworks. <br />He also read comments from Brooklyn Park and Shakopee indicating the same. City Attorney <br />Goodrich stated the draft ordinance under consideration is a somewhat more "middle of the road' <br />than the approach taken by some cities like Blaine. However, some city attorneys feel this is not <br />worthy of local city regulations. There is also concern that this may be just the start of <br />legislation related to regulations on the local level. City Attorney Goodrich stated the license <br />fees can only be the amount it actually costs the City to issue the license and anything more is <br />considered a tax. He stated staff needs to relate that the suggested $500 fee reflects a reasonable <br />charge related to the City's costs. <br /> <br />Mayor Gamec stated he has no problem with the draft ordinance and thinks it is reasonable. <br /> <br />City Council/June 11, 2002 <br />Page 16 of 30 <br /> <br /> <br />
