Councilmember Hendriksen stated at the last meeting he commented that the City is being more <br />careful about fireworks than it is with gallons of volatile paint or many containers of black <br />powder. However, he came to the meeting willing to support this draft ordinance to be on the <br />safe side. <br /> <br />Councilmember Anderson noted the fire in Brainerd may be attributed to fireworks. <br /> <br />Director of Public Works/Fire Chief Kapler stated that is a fact and reviewed the property loss <br />and cost to fight that fire as well as others. He stated if the need drops off, the fee level can be <br />reviewed on an annual basis. <br /> <br />Councihnember Anderson asked if the fee can be higher based on the repercussions of this use. <br /> <br />Councilmember Hendriksen asked if preparedness for an average incident or suppression effort <br />can be included in the fee. <br /> <br />City Attorney Goodrich stated the clerical work and cost of inspection of properties can be <br />included in the fee. He stated the State Legislature has indicated these fireworks are legal in <br />Minnesota. However, someone could purchase them in one location but use them in another <br />location. He stated the City is also trying to protect its firefighters so it is known where the <br />fireworks are. <br /> <br />Councilmember Zimmerman noted the cities that are not considering regulations do not contain a <br />vast amount of grasslands or timber. He stated he would support this ordinance as presented. <br /> <br />Mayor Gamec stated he questioned whether the $500 fee was reasonable, noting the fee for a <br />burning permit also involves an inspection but costs only $25. He suggested a fee of $250. <br /> <br />Councilmember Hendriksen suggested this fee be included in the schedule of fees that is adopted <br />annually. That would not tie the fee into this ordinance so it could be considered annually. <br /> <br />Community Development Director Frolik noted there is a separate resolution to deal with the fee <br />to be charged. <br /> <br />Councilmember Kurak indicated her support for a fee of $250 and noted this is a work in <br />progress and will change as the City becomes more familiar with what is involved. She noted <br />that next year there may be more leniency with fireworks in Minnesota and suggested the fee be <br />reviewed each year. <br /> <br />City Attorney Goodrich suggested a revision to Subdivision 6, second sentence, to indicate: <br />"The license fee for the Year 2002 shall be $250 and thereafter as set by the annual City Council <br />resolution establishing license fees." <br /> <br />City Council/June 11, 2002 <br />Page 17 of 30 <br /> <br /> <br />
