P40 <br /> <br />Motion carried. <br /> <br />Case #8: <br /> <br />Request for Approval of the Development Permit Relating to the Final Site <br />Plan for the Development of Lot 1, Block 1, Ramsey Town center 3rd <br />Addition; Case of Ramdanee, LLC <br /> <br />Community Development Director Frolik explained Case No. 8 and Case No. 9 will be reviewed <br />together, as the applicant has requested merging the two agreements into one document. The <br />document has been reviewed by City Attorney Goodrich, Assistant Public Works Director Olson, <br />and Shingobee Development; and is down to one unresolved item relating to storrnwater. <br /> <br />Assistant Public Works Director Olson explained the reason they had initially put this in was due <br />to stonnwater that is discharging not only into 'the southwest pond, which has been reconfigured, <br />but also into the Mississippi River. The condition of the final plat approval was that all lots <br />subject to final plat approval within Town Center shall have pretreatment in Best Management <br />Practices to try to infiltrate the water and treat the water quicker than what generally happens in a <br />regional treatment system. In the case of Ramsey Town Center 2® Addition, D. R. Horton, it <br />was decided to utilize a rain g~rden. That has not exactly been proven in s~aff's opinion, but it <br />was determined to give it a try. He explained the issue is basically that Shingobee Development <br />has some concern with the stormceptor not only handling this site, but also adjacent runoff from <br />the county road upgrades that are necessary as part of the final plat that was approved. He stated <br />staff does not care who pays 'for the improvement, but the City should not have that <br />responsibility. <br /> <br />Greg Voss, representative of Shingobee Development, stated the stormceptor came to their <br />attention this afternoon for the first time as an engineering drawing. The biggest concern is the <br />design and redesign of the storm pond was to create a water treatment process to create better <br />water quality, along with creating more density and tax base, and to accomplish both by <br />redesigning it. He stated 50 percent or more of the water that comes into the pond comes from <br />off of the RTC plat through the property to the west of Armstrong Boulevard. They have a <br />concern that this is being addressed for their third addition plat as their sole responsibility to treat <br />all that water. There are actually three pipes that flow into the pond. He stated he would like an <br />opportunity of finding a better resolve for that. Shingobee Development does believe in water <br />quality and in their design there are catch basins and oil separators throughout the plat. He is a <br />little off guard and does not' have a handle on this stonnceptor, but he does not feel now that this <br />plat is responsible for all the stormceptor for all of the water offsite. He stated their plat only <br />generates approximately 30 percent of the water going into that pond. <br /> <br />Mayor Gamec asked if this'could be approved contingent on the Engineer Agreement. He noted <br />there is drainage that will come from several different areas. <br /> <br />Assistant Public Works Director Olson indicated he understands the concern of Ramsey Town <br />Center 3rd Addition. His thoughts are that the agreement at the time the final plat was signed was <br />that there would be ponding and water quality treatment for all of the improvements necessary as <br />part of the final plat approval, those being county road improvements.
