Motion by Councilmember Kurak, seconded by Councilmember Cook, to receive the petition <br />f¥om RTC, LLC requesting construction of certain Phase II Improvements. <br /> <br />Motion came& Voting Yes: Mayor Gamec, Councilmembers Kurak, Cook, Elvig, Pearson, and <br />Strommen. Voting No: None. Absent: Councihnember Zimmerman. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Kurak, to adopt Resolution #04- <br />t 1-339 authorizing design of the Phase II improvements by Hakanson Anderson Associates, Inc., <br />outlined in the Hakanson Anderson. Associates, Inc. letter dated November 4, 2004 in the amount <br />of $56,900. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Kurak, Cook, Pearson, and <br />Strommen. Voting Nb: None. Absent: CouncilmernberZimmerman. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Elvig, to approve resolution #04- <br />11-340 authorizing the preparation of a feasibility'study tbr the City Phase II improvements. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councih-nembers Cook, Elvig, Kurak, Pearson, and <br />Strommen. Voting No: None. Absent: CouncilmemberZimmerman. <br /> <br />Case#14: Approve Purchase Agreement for the Purchase of the Highway 10 <br /> Corridor/Miller Property <br /> <br />City Attorney Goodrich reviewed that the City has been negotiating with Earnest Miller for the <br />acquisition of his parcel of land lying within the Highway 10 corridor Official Map area. The <br />parcel is located at 6159 Highway 10 NW. The funds for the purchase are from a Metropolitan <br />Council RALF loan. The loan proceeds will be reimbursed to the Metropolitan Council by <br />MnDOT when MnDOT has need for the parcel. The total purchase price is $340,000. In <br />addition, because the City commenced a condemnation action for acquisition of a storm drainage <br />easement across the parcel, the City owes the landowner his attorney fees incurred' in the <br />condemnation action per State statute. The amount is $943.72, which is a reasonable amount. <br />He noted this approval is contingent on fonrtal approval .by the Metropolitan Council. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Kurak, to enter into a .purchase <br />agreement with Earnest R. Miller, Trustee of the Earnest R. Miller Revocable Trust U/A dated <br />November 3, 2000 for the purchase of the parcel of land located at 6159 Highway 10 NW, <br />Ramsey, Mi~mesota, for a total purchase price of $340,000.00, which purchase price is to be <br />funded by a Metropolitan Council RALF loan. This motion is contingent on formal approval by <br />the Metropolitan Council approving the purchase and the purchase price. In addition, the City <br />shall reimburse the landowner for his attorney fees in the amount of $943.72 relating to a <br />previous City condemnation action. <br /> <br />Further discussion: Councilmember Elvig indicated he has had a lot of conversations with <br />people that get uptight about the Met Council and MnDOT.
