Councilmember Kurak requested clarification on the access through Outlot A. <br /> <br /> Community Development Director Frolik replied it was the intent when Regency Pond was <br /> platted that access would be from Regency Pond and-probably not from CR 56. Working <br /> through this plan with Mr. Schmidt and the county it was determined that the development to the <br />· east woUld be better served by a common ~access onto Ramsey Boulevard and ending the' 148'h <br /> stub into a permanent cul-de-sac. <br /> <br />Councilmember Kurak questioned if there Will 'be an access to CR 56 when this development <br />takes place or at a later date. <br /> <br />Ms. Frolik replied the access will occur when this development takes place. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Kurak, to adopt Resolution #04- <br />11-357 to grant final plat approval of Regency Pond 4th Addition contingent upon compliance <br />with the City Staff Review Letter dated November 19, 2004, a. fon-nalized access agreement <br />regarding Outlot A, and the applicant entering into a Development A~eement with the City. <br /> <br />Motion carried. Voting Yes: MayOr Gamec, Councilmembers Elvig,-Kurak, Cook, Pearson, <br />Strommen, and Zimmerman. Voting No:. None. <br /> <br />Case #7: <br /> <br />Request for Final Plat Approval of Rowe Addition; Case of John Rowe <br /> <br />Community Development Director Frolik indicated the applicant is requesting final plat approval <br />of a minor subdivision to plat. a 2.5 aCre homestead from a 40 acre parcel located at 6530 Green <br />Valley Road. The property currently contains one home and the Green Valley Greenhouse <br />operation. The purpose of the plat is to separate the uses and create a 2.5 acre lot for the <br />homestead. The subdivision would facititateMr. Rowe's intention to sell the home independent <br />of the business, city Code requires-each lot to have a minimum of 200 feet of street frontage on <br />a public road. Lot 1, Block 1, the existing homestead, is proposed to have 100 feet of frontage <br />on Green Valley Road. Mr. Rowe applied for the variance. The purpose of the variance is that <br />Mr. Rowe wants to provide the minimum amount of land necessary for the homestead. Because <br />the home is situated so far south on the property, a lot 200 feet wide from the street to behind the <br />home would exceed 2.5 acres. The Board of Adjustment granted the variance on October 7, <br />2004. The Planning Commission and staff recommend approval contingent upon compliance <br />with City Staff Review Letter dated November 18, 2004. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Pearson, to adopt Resolution <br />#04-11-358 granting final plat approval to Rowe Addition contingent upon compliance with City <br />Staff Review Letter dated November 18, 2004. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councih-nembers Cook, Pearson, Elvig, Kurak, <br />Strommen, and Zimmerman.
