Assistant Community Development Director Trudgeon explained that the maximum front yard <br />setback in the TC-2 district is 0-15 feet.. He stated the Pond building does not comply with this <br />standard and the applicants have applied for a variance which was ganted by the Board of <br />Adjustments previously this evening. <br /> <br />Assistant Community Development Director Trudgeon advised the site grading was reviewed as <br />part of the Phase 1 approval process. He indicated that the restaurant building has since been <br />modified to include a drive-up window, which will require revisions to the grading plans. He <br />stated the west side of the building includes an outdoor dining area that overlooks the landscaped <br />pond. He indicated that the selected architectural materials include brick, EIFS, split face CMU <br />integrally treated with color, and metal accents. He. stated Staff is requesting a sample of the <br />corrugated metal panel material noted on the building elevations. <br /> <br />Commission Input <br /> <br />Chairperson Nixt indicated he would like to see the applicant incorporate the changes to the <br />parking stalls and driveway lane referenced in the previous case. <br /> <br />Commissioner Van Scoy added that the overall plan after expansion will be critical in addressing <br />Chairperson Nixt's concerns. <br /> <br />Commissioner Jeffrey asked if it was okay for the applicant to surface over.a utility easement. <br /> <br />Assistant Community Development Director Trudgeon indicated it is not the City's easement, <br />but typically it is allowable with the applicant taking the risk that if it needs to be torn up it will <br />be at the applicant's expense.. <br /> <br />Chairperson Nixt indicated that it looks like there is parking shown in the pond area. <br /> <br />Mr. Schrock indicated that it is a temporary pond that will be changed after grading is cdmpleted. <br /> <br />Commissioner Brauer asked what protection was built in so the pond does not turn into a junk <br />area. <br /> <br />Mr. Voss stated they have a joint maintenance agreement with the City. He indicated the City <br />will do the maintenance they would normally do on a pond and Ramdance, LLC will take <br />responsibility, for the quality of the water. <br /> <br />Colmnissioner Brauer asked if they had considered some type of aeration device. <br /> <br />Mr. Voss indicated they are looking at that now; possibly some type of fountain that would <br />double as an aeration system. <br /> <br />Chairperson Nixt asked if when the Planning Commission granted variances to the floor area <br />ratio it was a blanket variance or was to a specific percentage. <br /> <br />Planning Commission/December 2, 2004 <br /> Page 6 of 19 <br /> <br />19 <br /> <br /> <br />
