Putnam to ignore the comment regarding being evasive because it did not represent the entire <br />City CoUncil. <br /> <br />Councilmember Anderson noted that Mr. McDilda stated preliminary plat approval was based on <br />misinformation. <br /> <br />City Attorney Goodrich stated he did not have any evidence on that. <br /> <br />Councilmember Anderson stated the cul-de-sac length had to be adjusted. <br /> <br />City Attorney Goodrich stated that was adopted pending a variance for that. <br /> <br />Community Development Director Frolik stated that was withheld from the original plat to go <br />back and get the variance to the cul-de-sac length. <br /> <br />City Attorney Goodrich stated the preliminary plat was granted contingent on getting that <br />variance. He asked ifa public hearing was part of that variance process. <br /> <br />Community Development Director Frolik stated this was true. <br />inclined to grant final plat approval they needed to look at <br />agreement. <br /> <br />She stated if the Council was <br />item #23 of the development <br /> <br />City Attorney Goodrich asked how Community Development Director Frolik recommended this <br />be amended. <br /> <br />Community Development Director Frolik stated that tree removal would be restricted to the <br />limits of the grading required to construct the road and the house pad on Lot 2. <br /> <br />City Engineer Jankowski stated it should read "the developer is only initially allowed to remove <br />trees contained to the right-of-way, and together with that area necessary to achieve a three to <br />one back slope and to grade the building pad on Lot 2." <br /> <br />Councilmember Hendriksen stated the other way to handle this issue is to do what the sentence <br />says and that is not to allow grading until the building permit is pulled on that lot when they <br />would actually know what would be built there and that is what the agreement says. <br /> <br />Community Development Director Frolik stated that however it goes, she wanted this sentence <br />crafted. <br /> <br />Councilmember Kurak stated the reason they wanted extra area for grading was to facilitate <br />putting in the facilities, it was not to facilitate building the pad. <br /> <br />City Engineer Jankowski stated the majority was necessary to facilitate putting in the street and <br />utilities. <br /> <br />City Council/June 25, 2002 <br />Page 17 of 34 <br /> <br /> <br />
