Councilmember Anderson stated they were requesting a conditional use permit for three to five <br />years with the option of receiving clean fill not to exceed 10,000 yards annually. She wanted to <br />know if they were excavating sand, what would be clean fill. <br /> <br />Mr. Thompson stated there was little or no topsoil on this and his idea was to improve the quality <br />of the soil. <br /> <br />Councihnember Anderson stated sand was the fill normally used. <br /> <br />Mr. Thompson stated this was importing of top soil only to restore the site. <br /> <br />Councihnember Anderson stated it would be environmentally clean. <br /> <br />Mr. Thompson stated this was true. <br /> <br />City Engineer Jankowski stated the permit was for three years only and would need to be <br />approved every three years. <br /> <br />The City Council reviewed the following Findings: <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />1.8. <br /> <br />19. <br /> <br />That the grading operation will increase the traffic to and from the subject <br />property for the period of time the permit is in effect. <br />That the proposed use will not be unduly dangerous or otherwise detrimental to <br />persons residing or working in the vicinity of the use or to the public welfare. <br />That the proposed use will not substantially adversely impair the use, enjoyment, <br />or market value of any surrounding property. <br />That the proposed use will not be hazardous or disturbing to existing or future <br />neighboring uses. <br />That the proposed use will not be a substantial improvement to property in the <br />immediate vicinity and to the community as a whole. <br />That the proposed use will not be served adequately by public facilities and <br />services such as highways and streets. <br />That the proposed use will not create excessive additional requirements at public <br />cost for public facilities and services, and it will not be detrimental to the <br />economic welfare of the community. <br />That the proposed use will not involve uses, activities, processes, materials, and <br />equipment and conditions of operation that will be detrimental to any persons, <br />property, or the general welfare by reason of excessive production of traffic, <br />noise, smoke, fumes, glare, or odors. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Zimmerman, to adopt <br />Resolution #02-06-159 adopting Findings of Fact #0622 relating to Eric Thomsen's request for a <br />conditional use permit to grade and export soils. <br /> <br />City Council/June 25, 2002 <br />Page 28 of 34 <br /> <br /> <br />
