Councihnember Hendriksen stated that he would still entertain a motion for a forty-foot setback <br />if Mr. Ronallo would like to start the project early. <br /> <br />Mr. Ronallo stated that he would wait because July 11 was not that far away. <br /> <br />Case #9: <br /> <br />Request for a Conditional Use Permit to Grade and Export Soils; Case of <br />Eric Thomsen <br /> <br />City Engineer Jankowski stated the City has received an application from Eric Thomsen to grade <br />and export soils from an area generally located west of T.H. #47 and south of County Road #63, <br />at about Vanadium Street N.W. The subject property consists of 63 acres of which the proposed <br />activity would be confined to 9 acres. The City Council originally approved a conditional use <br />permit for grading and exporting of soil from this property on March 25, 1997. The applicant did <br />not initiate the conditional use permit within this three-year timeframe. The applicant <br />subsequently applied for and received a new conditional use permit to mine material on May 23, <br />2000, which was to expire two years from the date of commencement of the operation, but no <br />later than three years from the date of issuance. Material was mined for the T.H. 47 project in <br />June 2000, and for additional uses thereafter. The applicant desires to continue the mining and <br />grading operation to completion of the original proposal of nine acres; and has reapplied for a <br />continuation of the mining and grading conditional use permit. He stated Staff recommends <br />approval of the permit contingent upon the following conditions: <br /> <br />1) <br /> <br />2) <br /> <br />3) <br />4) <br />5) <br /> <br />A like number of trees being planted to replace the removed trees. The trees should be a <br />minimum of 1-1/2 inches in diameter and be of similar species to those removed. <br />The Grading Plan being modified to show the extent of the topsoil stockpile area and <br />final grades. <br />That the clean fill requested for importation is limited to topsoil for restoration purposes. <br />That all applicable environmental permits are obtained. <br />That the applicant obtain a permit from Anoka County Highway Department if necessary. <br /> <br />Councilmember Anderson noted that the letter they received included two references about when <br />the excavation was finished. They intend to use the property for agricultural purposes with the <br />finished grade well above the high water level so as to leave the property suitable for building <br />and later on the letter stated they were not developing this. <br /> <br />Mr. Eric Thompson, 6210 Green Valley Road NW, stated he did not have any intention to build <br />on the property at any time in the near future. He stated farming was his hobby and that is what <br />he planned on doing. <br /> <br />Councilmember Anderson asked why the statement was made to leave the property suitable for <br />building. <br /> <br />Mr. Thompson stated he would not be mining below the water line. <br /> <br />City Council/June 25, 2002 <br />Page 27 of 34 <br /> <br /> <br />
