Community Development Director Frolik stated it was on portions of the property. <br /> <br />Councihnember Zimmerman asked where they were in this request. <br /> <br />City Attorney Goodrich stated they discussed this in March and Mr. Kurak brought forth a letter <br />requesting an additional 60 days. He stated several letters from Mr. Kurak asked the Council to <br />not act on this pending work with the neighbors to discuss these land use issues. He stated since <br />March 12, there had been two to three letters extending this in thirty-day increments. To date <br />they did not have a letter extending this another 30 days so in order to comply with the sixty day <br />rule, MS1599, they need to act on this tonight. <br /> <br />Councilmember Zimmerman asked what would happen if'they did not act on this tonight. <br /> <br />City Attorney Goodrich stated that if they did not act on this tonight, based on the statute, the <br />Kurak application would be deemed approved because the City would have violated the Statute. <br /> <br />Mayor Gamec stated that either way, because of a letter requesting that group not to continue, the <br />Council would need to take action at the meeting. <br /> <br />City Attorney Goodrich stated there was not a letter requesting the group not to continue. <br /> <br />Mayor Gamec asked if they could continue to meet. <br /> <br />City Attorney Goodrich stated they could. He asked City Administrator Norman if they had a <br />letter from Mr. Kurak. <br /> <br />City Administrator Norman stated Mr. Kurak was going to submit the letter until the request was <br />put on the agenda to vote; he refused to submit another letter. <br /> <br />City Attorney Goodrich stated that in order to be in compliance with the Minnesota State Statute, <br />the Council needed to vote on this tonight. <br /> <br />Councihnember Hendriksen showed a drawing of the planned development. He stated he did not <br />attend any of the meetings but had the meeting minutes. He stated there was not an <br />overwhelming consensus that some people suggested that there might be in terms of general <br />acceptance of this. He stated the diagram did not match with the request that was made in terms <br />of what portion they were requesting the land use change for. He stated it seemed appropriate <br />that if this kept changing, they should not consider this to be part of the fourteen requests that <br />were grandfathered in last year and actually follow the process that exists in making the land use <br />change. Councihnember Hendriksen pointed out that he believed this was for the entire parcel, <br />or at least a portion of the parcel, not just twenty odd acres that were depicted in the drawing so <br />he believed action was appropriate. <br /> <br />Mayor Gamec stated they needed to take action on this no matter what. <br /> <br />City Council/June 25, 2002 <br /> Page 6 of 34 <br /> <br /> <br />
