9) Adopt Resolution #02-08-194 Approving 1st Partial Payment to Don Zappa and Son for <br /> hnprovement Project #01-35 (Kovar Addition Utility Extensions Project AKA/SW Extension <br /> Ramsey Professional Building) <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Anderson, Zimmerman, <br />Hendriksen, and Kurak. Voting No: None. <br /> <br />COUNCIL BUSINESS <br /> <br />Case #1: <br /> <br />Public Hearing: Request to Vacate a Portion of Drainage and Utility <br />Easement in Amber Ridge: Case of Carole Nielsen <br /> <br />Mayor Gamec closed the regular portion of the City Council meeting at 7:30 p.m. in order to <br />conduct a public hearing. <br /> <br />Public Hearing <br /> <br />Mayor Gamec called the public hearing to order at 7:30 p.m. <br /> <br />Presentation <br /> <br />City Engineer Olson stated that Carole Nielsen resides at 14950 Argon Street NW and is <br />proposing to construct a utility shed in her back yard. However, a substantial portion of her back <br />yard is encumbered by a drainage and utility easement. Ms. Nielsen has submitted a request to <br />vacate a portion of that easement. The City Engineer indicated that at the time Amber Ridge <br />was platted, the drainage plan called for the transmission of runoff from the detention pond <br />located south of the subject property to the wetland through a wide backyard swale. In 2000, a <br />storm sewer outlet from the wetland to the north was constructed as a part of the work associated <br />with the T.H. #47 project. Therefore, the large drainage easement that was necessary when <br />Amber Ridge was platted is no longer required due to the subsequent drainage project. <br /> <br />Citizen Input <br /> <br />Carole Nielsen, 14950 Argon Street NW, Ramsey, stated that she received an updated map today <br />and she was fairly comfortable with the map, but she did have one question. She stated that <br />originally, when the map was done, the back side had a 20 foot easement and then it was moved <br />to ten feet but her property line was six feet from drainage pipe, plus 10 feet. <br /> <br />City Engineer Olson stated that the plan before them identifies a 20-foot drainage easement. He <br />noted that the Council could introduce the ordinance and then staff can address the concerns <br />before the ordinance is adopted. <br /> <br />City Council/August 19, 2002 <br /> Page 5 of 11 <br /> <br /> <br />
