Motion by Councilmember Zimmerman, seconded by Councilmember Kurak, to approve Wayne <br />and Pamela Steinke's request to exceed accessory building height and size restrictions based on <br />the findings of fact, and adopt Resolution #02-09-230 declaring terms of same. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Zimmerman, Kurak, <br />Anderson, and Hendriksen. Voting No: None. <br /> <br />Case #4: <br /> <br />Request for a Conditional Use Permit to Exceed Height Restrictions for <br />Accessory Structures; Case of William and Elizabeth Erhart <br /> <br />Community Development Director Frolik stated that City Code restricts accessory structure <br />building heights to 16 feet inside the Metropolitan Urban Service Area (MUSA). The total <br />amount of accessory structure space allowed on a parcel is regulated by parcel size. The City <br />received an application from William and Elizabeth Erhart for a conditional use permit to exceed <br />the detached accessory building height established in City Code on the property located at 4740 <br />154'~' Lane NW. The subject property is approximately 4.5 acres in size and is located within the <br />Metropolitan Urban Service Area (MUSA). The applicant is proposing to construct a detached <br />accessory building that would be approximately 22 feet in height, which results in about a 6-foot <br />deviation from City Code. The applicant would like to exceed the 16-foot height restriction in <br />order to match the roofline of the principal structure and provide for additional overhead storage. <br />The Planning Commission held a public hearing and reviewed the request on August 29, 2002. <br />There was no citizen opposition during the public hearing. The Planning Commission <br />recommended that the City Council approve the conditional use permit request. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Kurak, to adopt Resolution <br />#02-09-231 adopting Findings of Fact #0630, in the affirmative, relating to William and <br />Elizabeth Erhart's request for a conditional use permit to exceed accessory structure height <br />requirements on the property at 4740 154th Lane. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Kurak, Anderson, <br />and Zimmerman.
