Mayor Gamec replied that all indication so far is that the County has complete control of the <br />land. <br /> <br />Councilmember Hendriksen stated that they have already seen that the County has not been <br />looking out for the best interest of the City in this matter and so if the City owns the land they <br />might have better control over what is built on the property. He also agreed that part of the deal <br />was to provide a certain amount of commercial on the property so he did not want to attempt to <br />discuss the option of purchasing the land until they know for sure the City is not already entitled <br />to the land. <br /> <br />2) Stormwater Assessment Policy <br /> <br />City Engineer Olson reviewed the uses of the storm drainage utility fund as well as the storm <br />water management fund as well as language for a policy relating to the use of the Storm Water <br />Management Funds. <br /> <br />Councihnember Zimmennan inquired if there are ever enough funds in the Storm Water <br />Management Fund to complete any projects. <br /> <br />City Engineer Olson replied that the current balance of the Fund is $495,000. <br /> <br />Councihnember Hendriksen stated that he could envision a project being built that could use the <br />entire amount. He stated that he did not like the City having the obligation of paying the costs up <br />front. He felt that a better scenario would be the developer paying all the costs initially and as <br />other properties come on line then the developer would be reimbursed. In order to build the <br />initial phases of the town center the City might have to build a lot of large infrastructure out to <br />the Mississippi River, which could easily exceed the $400,000 and that is not something he <br />would want to bond for. <br /> <br />City Engineer Olson replied that as it relates to the town center site, staff has looked at the <br />infi'astructure that would be needed and if there were 2,000 units built within the town center site <br />the amount of money collected in storm water management funds would cover those expenses. <br /> <br />Councilmember Hendriksen stated that the point he was trying to make is that the initial phase <br />would be commercial and the first phase might bring in $37,000, but the infrastructure to the <br />river might be $100,000. <br /> <br />City Engineer Olson suggested that they have the developer fund the up-front costs and then as <br />future development occurs the storm water development fund will be paid into that infrastructure <br />at the rate of when the development was approved. <br /> <br />Councilmember Hendriksen replied that he did not think it was reasonable to allow the developer <br />to receive the benefit of an earlier rate if the development does not occur until a future date. <br /> <br />City Council/September 17, 2002 <br /> Page 3 of 6 <br /> <br /> <br />
