Councilmember Zinqmerman stated that the comprehensive plan is a plan that is supposed to last <br />approximately ten years so he was not sure that they could have something that would be <br />changing every six months. <br /> <br />Principal Planner Trudgeon explained that the language presented is an attempt to state that, <br />under certain circumstances, the Council would change a zoning or land use designation and if <br />the developer does not comply with the terms of the agreement, then the Council will start the <br />process to change the zoning or land use back to its original designation. The one thing they <br />have no control over is the response of the Met Council. <br /> <br />Councilmember Kurak stated that she thought the concept was a good idea, but expressed <br />concern about the unknowns. <br /> <br />Councilmember Anderson recommended that they submit an amendment to the comprehensive <br />plan including the language to get a response from the Met Council <br /> <br />City Attorney Goodrich replied that the Council would not be amending the comprehensive plan <br />by adopting the ordinance. <br /> <br />Councilmember Anderson stated that they can't make any of it work unless they work out <br />something with the Met Council. <br /> <br />Councilmember Zimmerman stated that the process would have to be first initiated by the <br />developer. <br /> <br />Councilmember Hendriksen stated that the Council can submit an amendment to the Met Council <br />for approval and then the Council can decide whether or not to approve the amendment. <br /> <br />City Attorney Goodrich noted thai the Council can either adopt an amendment prior to <br />submitting it to the Met Council or they can adopt it after it has been submitted. <br /> <br />Councilmember Hendriksen stated that his concern is that the City gives something up and the <br />Met Council never gives anything back. <br /> <br />City Attorney Goodrich stated that the practical part is that very rarely does the City have a <br />developer come in and request a comprehensive plan amendment. A rezoning request is much <br />more common. <br /> <br />Councilmember Hendriksen explained that what brought the issue forward is that they were <br />talking about changing the business park to a mixed use designation and what is permitted within <br />the mixed use is a wide variety. <br /> <br />City Attorney Goodrich stated that when they get into the ordinance they are narrowing the broad <br />approach of the comprehensive plan because they are saying to the landowner that the Council <br /> <br />City Council/September 24, 2002 <br /> Page 3 of 6 <br /> <br /> <br />
