findings of fact, contingent upon receiving a variance to height restrictions, and adopting <br />Resolution #02-09-251 declaring the terms of the conditional use permit adding Condition #15 to <br />read as follows "That the permittee shall provide the City with a letter of credit in the amount of <br />125 percent of the improvements and which letter of credit shall be in the form approved by the <br />City", changing the wording of Condition #6 to read "That the Permittee shall .... ", and changing <br />the wording in Condition #12 to read "The terms of the conditional use permit shall be binding <br />upon its successors and assigns." <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Anderson, Hendriksen, <br />and Zimmerman. Voting No: None. <br /> <br />Mayor Gamec recessed the regular meeting of the City Council at 9:00 p.m. <br /> <br />Mayor Gamec called the regular meeting of the City Council back to order 9:12 p.m. <br /> <br />Case #6: <br /> <br />Request for Preliminary Plat Approval of Villas of Meadows Point: Case of <br />Allstate Development, LLC <br /> <br />Principal Planner Trudgeon stated that Allstate Development LLC has applied for preliminary <br />plat approval for a townhome development. The property is generally located in the triangular <br />area formed by the intersection of Nowthen Boulevard, Sunfish Lake Boulevard., and Alpine <br />Drive. The Planning Commission reviewed the sketch plan for the property at the June 6, 2002 <br />meeting. The sketch plan showed a total of 157 townhouse units (comprised of two-unit and <br />sixteen-unit townhome buildings). The preliminary plat shows the first phase of the <br />development and consists of 19, two-unit townhome buildings and six single-family lots for a <br />total of 44 housing units. The property is currently zoned R-2, Medium Density Residential and <br />R-1 Single Family Residential. The townhomes are shown on the property zoned R-2 and the <br />single-family lots are shown on the land zoned R-i, with the exception of the existing single~ <br />family house shown on the northwest portion of the development. The property is approximately <br />23.36 acres in size. The preliminary plat shows two large outlots that will be subdivided in the <br />future. When the acreage of the outlots (8.6 acres) are factored out, the net density shown on the <br />preliminary plat is 2.8 units per acre. The sketch plan reviewed in June 2002, showed seven, 16- <br />unit townhouse buildings. The R-2 Zoning District allows for a maximum of ten units per <br />building. Allstate has submitted a request for a zoning ordinance amendment to increase the <br />number of allowable units per building to 16 units in the R-2 District. The amendment will be <br />considered at the October Planning Commission meeting. If the amendment is approved, <br />Allstate will be bringing forward a preliminary plat subdividing the large outlot with 16-unit <br />townhome buildings. The townhomes will be subject to a site plan review in October for all <br />other aspects of the proposal including, but not limited to, architectural standards, off-street <br />parking, structure setbacks, and landscaping. The results of the site plan review may impact the <br />actual number of townhomes to be developed on the property and the preliminary plat approval <br />will be subject to final site plan approval by the City Council. The R-2 Zoning District does not <br />have a minimum lot size for townhouse units.
