Home rule charter cities <br /> <br />The city clerk in a home rule charter city may be appointed'or elected, <br />depending upon the city's charter provisions. Home rule chalnter cities <br />should consult their city charters for details. <br /> <br />B. Powers and duties <br />Numerous 'duties rest With the 'city clerk. These duties are found in general <br />areas of laW, such as. elections law. Clerk duties are also scattered <br />throughout the statutes, which set forth a specific form or procedure the <br />clerk must follow. <br /> <br />Statutory city clerks have specific duties depending on the type of city. In <br />addition, statutory clerks also have general duties that apply regardless of <br />the city type. Further,'the council may develop other ministerial duties <br />specific to the city's needs. Home rule charter city clerks should consult <br />their city charter to find their specific powers and duties. <br /> <br />Some of the specific and general powers and duties of city clerks are <br />discussed below. <br /> <br />1. Standard Plan and Plan A cities <br />Standard Plan and Plan A city clerks have several specific duties set forth <br />by statute. Specific duties include the following: <br /> <br />· Provide notice of each regular and special-meeting. <br /> <br />· Record the proceedings of each regular and special meeting. <br /> Notify.officials oftheir election or appointment to office. <br /> <br />· CertifY to county auditor all appointments and results of city elections. <br /> <br />· Keep a minute book containing all of the city council proceedings. <br /> <br />· Keep an ordinance book recording all of the ordinances passed by the <br /> council. <br /> <br />· Act as a bookkeeper of the city and keep an account book to enter all <br /> money transactions of the city, including the dates and amounts of ail <br /> receipts, the person fi'om vfhom the money was received, as well as all <br /> orders drawn upon the treasurer with their payee and object. <br /> <br /> Act as custodian of city's seal and records. <br /> <br />· Sign all official city paperb. <br /> <br />· Post and publish such notices, ordinances, and resolutions as may be <br /> required. <br /> <br />· Perform such other duties as may be imposed by the council. <br /> <br />( ily .4. dm/~lis{ratiol~ <br /> <br />13 <br /> <br />-35- <br /> <br /> <br />
