StaL §§ 412.591, <br />subd. 2, 412.02, subd. 3. <br /> <br />In addition to these duties, Standard Plan city clerks also must serve as <br />members of' the council. <br /> <br />2. Plan B Cities <br /> <br />Plan B city clerks are subject to the direction of the city manager and have <br />the following statutory duties: <br /> <br />· l<.eep public ,'ecords. <br /> <br />· Maintain custody of and disburse public funds. <br /> <br /> · Administer city affairs as ordained by the council. <br /> <br />Itl addition to the above duties, the clerk maY be designated to act as <br />secretary to the council. <br /> <br />3. Home rule Charter cities <br /> <br />As previously mentioned, the r01e or' a city clerk in a home rule charter city <br />will depend upon provisions in the city's charter. Home rule charte~' cities <br />should consult their chat~ters to determine whether there is a clerk position <br />within the city and what specific powers the clerk possesses. <br /> <br />4. . Financial responsibilities <br /> <br />The clerk maintains all financial records. When the city has combined the <br />office of clerk and treasurer, tile clerk perf'orms all duties. In addition, the <br />clerk is responsible for preparing financial reports. <br /> <br />lfthe council makes appropriations or allotments under a budget, the clerk <br />usually has the duty of administ(:ring the budget. <br /> <br />In addition, as general city administrative officer in charge of payroll, the <br />clei'k must also withhold state and federal income taxes from the paychecks <br />of all employees. In cities without a finance officer or department, the city <br />clerk may also be responsible for monthly payroll deductions and reports <br />for the Public Employees' Retirement Association (PERA) and Social <br />Security contributions fi'om each employee. <br /> <br />The Council can, by ordinance, combine tile offices of clerk and treasurer <br />into a clerk-treasurer position, In a Standard Plan city, where both the clerk <br />and the treasurer are elected, the ordinance must be adopted at least 60 <br />days before the city's next general election.
