(the "Subject Property") <br /> <br /> WHEREAS, on December 14, 2001, the City of Ramsey received an application <br />preliminary plat from the Developer, for a proposed plat; and <br /> <br /> WHEREAS, on December 14, 2001, the City of Ramsey received an application to <br />rezone the subject property from R-1 and B-l, to R1-U, R3-U, and Multiple Residential. <br /> <br /> WHEREAS, on January 3, 2002, the Planning Commission reviewed the preliminary <br />plat and recommended approval of the plat subject to certain conditions; and <br /> <br /> WHEREAS, on January 3, 2002, the Planning Commission reviewed the application to <br />rezone the subject property from R-1 and B-l, to RI-U, R3-U, and Multiple Residential and <br />recommended approval of the request; and <br /> <br /> WHEREAS, on January 10, 2002, the Park and Recreation Commission reviewed the <br />proposed plat and recommended that the that the park dedication be satisfied with a combination <br />of land dedication, cash, and trails; and <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Ramsey City Council hereby grants preliminary plat approval to Royal Oaks Realty, Inc <br />for The Ponds subdivision subject to the following conditions: <br /> <br />a) The applicant removing a total of two residential lots from Blocks 2 and 3 of the plat. <br />b) Compliance with City Staff review letter dated December 31, 2001, Revised February <br /> 6, 2002. <br />c) The rezoning of the property from R-1 and B-l, to R1-U, R3-U, and Multiple <br /> Residential. <br />d) Completion of a biological survey to determine the existence of Blanding's Turtles on <br /> the Subject Property. <br />e) No grading on the Subject Property will be allowed, except in the proposed right-of- <br /> way, prior to Phase I of the biological survey being completed, after which time the <br /> developer shall comply with the requirements of the said biological survey. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Anderson, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gamec <br />Councilmember Kurak <br />Councilmember Anderson <br /> <br />RESOLUTION #02-02-041 <br /> Page 2 of 3 <br /> <br /> <br />
