47 minutes 32 seconds East, tangent to last said curve a distance of 164.54 feet; <br />thence southerly and westerly along a tangential curve concave to the west having <br />a radius of 295.27 feet, a central angle of 101 degrees 11 minutes 13 seconds, a <br />distance of 521.46 feet; thence South 89 degrees 23 minutes 42 seconds West, <br />tangent to last said curve a distance of 210.53 feet and said centerline there <br />terminating. <br /> <br />(" Subject Property") <br /> <br />4. That the Applicant is proposing to develop a multiple family housing project (townhomes <br /> and 2 single family homes) on an 11.3 acre site which includes the Subject Property. <br /> <br />o <br /> <br />That 9 acres of the 11.3 acre project site is zoned R-3 Urban Residential, but the portion <br />referenced above in the legal description as the Subject Property is zoned R-1 Urban <br />Residential. <br /> <br />6. That the Subject Property to be rezoned is approximately 2.3 acres in size. <br /> <br />o <br /> <br />That the Subject Property is located within the Metropolitan Urban Service Area (MUSA) <br />boundary. <br /> <br />That the abutting property to the north is zoned R-1 Residential, the property to the west <br />and the property on the west side of Sunwood Drive is part of the proposed plat and <br />development project and is zoned R-3 Urban Residential, the property west of the proposed <br />plat is zoned R-1 Urban Residential, the property to the south was recently rezoned from B- <br />1 Business to R-3 Urban Residential and the Subject Property is bounded by T.H.//47 on <br />the east. <br /> <br />That the Applicant is proposing a development project that is compatible with the 2001 <br />Comprehensive Plan. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Anderson, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gamec <br />Councilmember Anderson <br />Councilmember Kurak <br /> <br />and the following voted against the same: <br /> <br />Councilmember Hendriksen <br />Councilmember Zimmerman <br /> <br />and the following abstained: <br /> <br />None <br /> <br />RESOLUTION//02-02-057 <br /> Page 2 of 3 <br /> <br /> <br />
