Board Member Johnson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #02-05-100 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0606 RELATING TO A <br />REQUEST FOR A VARIANCE FROM FRONT YARD SETBACK REQUIREMENTS IN <br />THE R-3 URBAN RESIDENTIAL DISTRICT <br /> <br /> WHEREAS, Oakwood Land Development, Inc., hereinafter referred to as "Applicant", <br />has properly applied for a Board of Adjustment variance to the front yard setback requirement <br />established in Section 9.20.14 (R-3 Urban Residential District) of the Ramsey City Code on the <br />property generally located west of St. Francis Blvd. N.W. and north of Alpine Drive, and legally <br />described as follows: <br /> <br />The East Half of the Southeast Quarter of the Northeast Quarter of Section 23, Township <br />32, Range 25, Anoka County, Minnesota. <br /> <br />(the "Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to <br />Section 9.03.05 of the Ramsey City Code on May 2, 2002, and that said public hearing was <br />properly advertised and that the minutes of said public hearing are hereby incorporated as a <br />part of these findings by reference. <br /> <br />That the Subject Property is currently being considered for a rezoning from B-1 Business and <br />B-2 Business to R-3 Urban Residential and the Applicant has made proper application to the <br />City to develop the Subject Property with townhome units. <br /> <br />3. That Section 9.20.14 of the City Code requires a front yard structure setback of thirty-five <br /> (35) feet from the right-of-way of public roads. <br /> <br />That on March 26, 2002, the City adopted a street policy for multiple family residential <br />developments that requires at least one main public street through the subdivision and the use <br />of private streets or driveway collectors to connect the dwelling units with the public street(s) <br />and reduce the number of driveways on public streets. <br /> <br />That it will be difficult for parcels guided for medium and high density residential <br />development in the 2001 Comprehensive Plan to achieve the densities prescribed in the <br />Comprehensive Plan while maintaining compliance with the policy requirement for at least <br />one main public street in the development and the current City Code requirement for a 35 <br />foot structure setback from public street rights-of-way. <br /> <br /> <br />
