o <br /> <br />That the City is in the process of amending the performance standards for the low, medium <br />and high density residential districts; and it is currently proposed to reduce the front yard <br />setback in the medium density residential district from 35 feet to 25 feet. <br /> <br />7. That the Applicant is requesting a 5 foot variance to the 35 foot setback requirement, which <br /> equates to a minimum front yard setback on the Subject Property of 30 feet. <br /> <br />8. That the special conditions causing the undue hardship do/do not result from the actions of <br /> the Applicant. <br /> <br />9. That if granted, the variance will not grant the Applicant any special privilege that is denied <br /> to other owners of lands, structures or buildings in the same district. <br /> <br />10. That if granted, the variance will not be materially detrimental to the purposes of the Ramsey <br /> Zoning Chapter or other property in the R-3 Urban Residential District. <br /> <br />11. That if granted, the variance will not substantially increase the congestion of public streets, or <br /> increase the danger of fire, or endanger the public safety, or substantially impair property <br /> values within the neighborhood. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Kociscak, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Nixt <br />Board Member Johnson <br />Board Member Kociscak <br />Board Member Brauer <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br />Board Member Reeve <br />Board Member Sweet <br />Board Member Watson <br /> <br />Resolution #02-05-100 <br />Page 2 of 3 <br /> <br /> <br />
