o

That the City is in the process of amending the performance standards for the low, medium
and high density residential districts; and it is currently proposed to reduce the front yard
setback in the medium density residential district from 35 feet to 25 feet.

7. That the Applicant is requesting a 5 foot variance to the 35 foot setback requirement, which
equates to a minimum front yard setback on the Subject Property of 30 feet.

8. That the special conditions causing the undue hardship do/do not result from the actions of
the Applicant.

9. That if granted, the variance will not grant the Applicant any special privilege that is denied
to other owners of lands, structures or buildings in the same district.

10. That if granted, the variance will not be materially detrimental to the purposes of the Ramsey
Zoning Chapter or other property in the R-3 Urban Residential District.

11. That if granted, the variance will not substantially increase the congestion of public streets, or
increase the danger of fire, or endanger the public safety, or substantially impair property
values within the neighborhood.

The motion for the adoption of the foregoing resolution was duly seconded by Board Member
Kociscak, and upon vote being taken thereon, the following voted in favor thereof:

Chairperson Nixt
Board Member Johnson
Board Member Kociscak
Board Member Brauer

and the following voted against the same:

None

and the following abstained:

None

and the following were absent:

Board Member Reeve
Board Member Sweet
Board Member Watson

Resolution #02-05-100
