Board Member Kociscak introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #02-05-104 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0608 RELATING TO A <br />REQUEST FOR A VARIANCE FROM FRONT YARD SETBACK REQUIREMENTS IN <br />THE R-3 URBAN RESIDENTIAL DISTRICT <br /> <br /> WHEREAS, Eighty-Seven LLC, hereinafter referred to as "Applicant", has properly <br />applied for a Board of Adjustment variance to the front yard setback requirement established in <br />Section 9.20.14 (R-3 Urban Residential District) of the Ramsey City Code on the property <br />generally located west of St. Francis Blvd. N.W. and south of Alpine Drive, and legally <br />described as follows: <br /> <br />Outlot A, Brandseth Addition, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to <br />Section 9.03.05 of the Ramsey City Code on May 2, 2002, and that said public hearing was <br />properly advertised and that the minutes of said public hearing are hereby incorporated as a <br />part of these findings by reference. <br /> <br />2. That the Subject Property is zoned R-3 Urban Residential and the Applicant has made proper <br /> application to the City to develop the Subject Property with 42 townhome units. <br /> <br />3. That Section 9.20.14 of the City Code requires a front yard structure setback of thirty-five <br /> (35) feet from the right-of-way of public roads. <br /> <br />4. That the Applicant is requesting to reduce the front yard setback by 10-feet so as to have the <br /> structures closer than 25 feet from edge of the public street right-of-way. <br /> <br />That on March 26, 2002, the City adopted a street policy for multiple family residential <br />developments that requires at least one main public street through the subdivision and the use <br />of private streets or driveway collectors to connect the dwelling units with the public street(s) <br />and reduce the number of driveways on public streets. <br /> <br />6. That the new street policy for multiple family developments establishes a structure setback of <br /> twenty-five feet (25) from the back of curb of private streets. <br /> <br />That it will be extremely difficult for parcels guided for medium and high density residential <br />development in the 2001 Comprehensive Plan to achieve the densities prescribed in the <br />Comprehensive Plan if the front yard structure setback from public roads is not adjusted. <br /> <br />8. That the City of Ramsey is currently considering amendments to Chapter 9, the Zoning and <br /> Subdivision Code. <br /> <br /> <br />
