Councilmember Kurak introduced the following resolution and moved for its adoption: RESOLUTION #02-06-159 A RESOLUTION ADOPTING FINDING OF FACT #0622 RELATING TO A REQUEST FROM ERIC THOMSEN FOR A CONDITIONAL USE PERMIT TO GRADE AND EXPORTS SOILS WHEREAS, the City of Ramsey received an application from Eric Thomsen for a re- issuance of a conditional use permit to grade and export excess soils from the property legally described as follows: That part of the Southwest Quarter of the Southwest Quarter of Section 2, Township 32, Range 25, Anoka County, Minnesota, lying northerly of the centerline of Trott Brooks, subject to easement of record; -and- The Northwest Quarter of the Southwest Quarter of Section 2, Township 32, Range 25, Anoka County, Minnesota, lying southerly of County Road #63 (the "Subject Property"). NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: That on May 13, 2002, Eric Thomsen, hereinafter referred to as "Applicant", properly applied for the re-issuance of a conditional use permit to grade and export excess soils from the Subject Property. That the City Council approved a conditional use permit for this property on March 25, 1997, but the conditional use permit was not initiated and completed within three years of the final action of the City Council and it is considered null and void. 3. That the City Council approved a conditional use permit on May 23, 2000 for the continuation of this same activity, which expires in June 2002. That the applicant applied for a permit renewal and appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.04 of the City Code on June 6, 2002 and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. 5. That the Applicant has submitted a grading plan last revised April 22, 2002, prepared by E.G. Rud & Sons, Inc.
