Board Member Johnson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #02-09-201 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0627 RELATING TO A REQUEST <br />FOR A VARIANCE TO CONSTRUCT AN ACCESSORY STRUCTURE CLOSER TO <br />THE FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE <br /> <br /> WHEREAS, William and Elizabeth Erhart, hereinafter referred to as "Applicants," have <br />properly applied for a variance from Section 9.11.02 of the Ramsey City Code to construct an <br />accessory structure closer to the front property line than the principal structure on the property <br />generally known as 4740 154th Lane NW and legally described as follows: <br /> <br />Lot 11, Block 1, Stanhope River Hills, Anoka County, Minnesota <br /> <br />(Subject Property) <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSE¥, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of the <br />Ramsey City Code on September 5, 2002, and that said public hearing was properly <br />advertised, and that the minutes of said public hearing are hereby incorporated as a part of <br />these findings by reference. <br /> <br />2. That the Subject Property is zoned R-1 Single Family, is located within the 2020 <br /> Metropolitan Urban Service Area, and is approximately 4.5 acres in size. <br /> <br />3. That the Subject Property is surrounded by properties zoned R-1 Single Family zoning. <br /> <br />4. That Section 9.11.02 of the Ramsey City Code does not permit the construction of accessory <br /> structures closer to the front property line than the principal structure. <br /> <br />5. That the principal structure on the Subject Property is approximately 169 feet from the <br /> property line. <br /> <br />6. That the Applicant is proposing to construct an accessory building that will be approximately <br /> 90 feet from the property line. <br /> <br />o <br /> <br />That City Code allows for a total of 2,864 square feet of garage and accessory buildings on <br />the Subject Property; the existing attached garage is 1,224 square feet in size; the proposed <br />garage is 1,008 square feet in size, for a total of 2,232 square feet of garage and accessory <br />building space. <br /> <br />That there are special conditions applying to the Subject Property that do not generally apply <br />to other properties in the district; namely, the east side yard and south rear yard contain steep, <br />declining grades; the west side yard contains a mound septic system and location for an <br />alternative septic system. <br /> <br />9. That the special conditions do not result from the actions of the Applicant. <br /> <br /> <br />
