Councilmember Kurak moved for the adoption of the following resolution: <br /> <br />RESOLUTION/t02-09-250 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT /10631 RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT TO EXPAND A LAWFUL <br />NONCONFORMING READY-MIX PLANT IN THE INDUSTRIAL DISTRICT. <br /> <br /> WHEREAS, Marshall Concrete, hereinafter referred to as "Applicant", has properly <br />applied for a Conditional Use Permit to expand a lawful nonconforming ready-mix plant on the <br />property generally known as 14141 Unity Street N.W. and legally described as follows: <br /> <br />Lot 3, Block 1, Park 67 Industrial Park; <br />-and- <br />The South 175 feet of West 110 feet of Lot 4, Block 1, Park 67 Industrial Park; <br />-and- <br />Outlot B, Business Park 95 5~ Addition; all in Anoka County, Minnesota. <br /> <br />(the "Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.04 of the Ramsey City Code on June 6, 2002, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />by reference. <br /> <br />That the subject property is located in the Industrial District and is approximately 2.6 acres <br />in size. <br /> <br />3. That the surrounding parcels are zoned Industrial. <br /> <br />That City Staff has determined that the existence of the concrete ready-mix plant on the <br />Subject Property is considered to be a lawful nonconforming use in the Industrial District. <br /> <br />That the Applicant has submitted a request for a conditional use permit to expand the <br />lawful nonconforming use to include a second industrial silo. <br /> <br />That the proposed use will not be unduly dangerous or detrimental to persons residing or <br />working in the vicinity of the use, or to the public welfare. <br /> <br />That the proposed use will not substantially adversely impair the use, enjoyment or market <br />value of any surrounding property. <br /> <br /> <br />
