Board Member Johnson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #02-11-280 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0636 RELATING TO A <br />REQUEST FROM RONALD CANNER, JR., FOR A VARIANCE TO THE SETBACK <br />FROM THE ORDINARY HIGH WATER MARK AND THE COUNTY ROAD IN THE <br />ROGERS LAKE SHORELAND OVERLAY DISTRICT FOR A NEW LOT PROPOSED <br />TO BE PLATTED ON THE NORTH SIDE OF 179TM LANE N.W. (COUNTY ROAD #27), <br />APPROXIMATELY 340 FEET WEST OF C.S.A.H. #7. <br /> <br /> WHEREAS, Ronald Canner, Jr., hereinafter referred to as "Applicant", has properly <br />applied for a Board of Adjustment variance from Section 9.21 (Environmental Protection), <br />Subsection 9.21.04 (Shoreland Overlay District Development Standards), Subd. 5 (Zoning <br />Provisions) of the Ramsey City Code on the property generally located on the north side of 179th <br />Lane N.W. (County Road #27), approximately 330 feet east of C.S.A.H. #7, and proposed to be <br />platted and legally described as follows: <br /> <br />Lot 1, Block 1, L.P.Keillor Addition, Anoka County, Minnesota <br />(the "Subject Property") <br /> <br /> NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF <br />THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to <br />Section 9.03.05 of the Ramsey City Code on November 7, 2002, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br /> <br />2. That the Subject Property is zoned R-1 Residential and is approximately 2.5 acres in size. <br /> <br />3. That the surrounding parcels are also zoned R-1 Residential. <br /> <br />4. That the Subject Property is within the Shoreland Overlay District for Rogers Lake and is <br /> classified in the Ramsey City Code as a Natural Environment Lake. <br /> <br />o <br /> <br />That Section 9.21.04 (Shoreland Overlay District Development Standards) of the Ramsey <br />City Code requires a structure setback of 200 feet from the Ordinary High Water (OHW) <br />mark of Rogers Lake. <br /> <br />That Section 9.20.11 (R-1 Residential District) of the City Code requires a setback from <br />major arterial roads of 60 feet from the right-of-way centefline plus the local applicable <br />setback, which on the Subject Property would be'the 40 foot front yard setback; for a total <br />setback of 100 feet from the right-of-way centerline of County Road #27. <br /> <br /> <br />
