That Section 9,21.04 (Shoreland Overlay District Development Standards) requires a <br />structure setback of 50 feet from County highway right-of-ways; in accordance with the <br />request of Anoka County, the Applicant will be dedicating an additional 27 feet of right of <br />way for County Road #27 on the proposed plat of L.P. Keillor Addition; the existing 33 feet <br />of right-of-way from the centerline combined with the additional 27 feet to be dedicated and <br />the required 50 foot setback thereto, results in a total setback from the centerline of County <br />Road #27 of 110 feet; this 110 foot setback requirement would take precedence over the 100 <br />foot setback required in the R-1 Residential District. <br /> <br />o <br /> <br />That Section 9.21.04 (Shoreland Overlay District Development Standards) establishes a <br />minimum lot size of 80,000 square feet for lots located in the shoreland overlay area of a <br />Natural Environment Water. <br /> <br />9. That the proposed lot to be platted as L.P. Keillor Addition by the Applicant will be 110,499 <br /> square feet in size. <br /> <br />10. That the combination of the 200 foot setback from the Rogers Lake OHW and the setback <br /> from the County road eliminates any possibility for a building pad on the Subject Property, <br /> even though the Subject Property exceeds the minimum lot size by approximately 30,500 <br /> square feet. <br /> <br />11. That Rogers Lake extends into the communities of Burns and Oak Grove and those <br /> communities have classified Rogers Lake as a Recreational Development Water for which <br /> the structure setback from OHW is 100 feet. <br /> <br />12. That the City is currently in the process of updating Chapter 9 (Zoning and Subdivision of <br /> Land) of the City Code and Staff will propose that Rogers Lake be reclassified as a <br /> Recreational Development Water with a structure setback from OHW of 100 feet, and will <br /> also propose to eliminate the 50 foot setback requirement from a County Road and maintain <br /> the standard established in the R-1 Residential District of 60 feet from the centerline of <br /> County road right-of-way plus the local applicable setback. <br /> <br />13. That the Applicant has provided the City with an exhibit produced by the U.S. Geological <br /> Survey that seems to reflect that the existing homes around the lake in Ramsey, Burus and <br /> Oak Grove are less than 100 feet from the shoreline of Rogers Lake; the scale of the image <br /> and the OHW is not identified on the exhibit and therefore this information cannot be <br /> verified. <br /> <br />14. That based on the U.S. Geological Survey image, the Applicant is requesting a variance to <br /> construct a home on the Subject Property that will be 75 feet from the OHW, comparable to <br /> existing homes around the lake. <br /> <br />Resolution #02-11-280 <br />Page 2 of 4 <br /> <br /> <br />
