• <br />WHEREAS, Minn. Stat. §469.124, in order to accomplish said statute's purpose, <br />authorizes cities, amongst other things, to develop a program for improving a Development <br />District of the City to provide impetus for commercial development, to increase employment, to <br />provide off - street parking to serve the shoppers and employees of the district to provide open <br />space relief within the District, to protect pedestrians from vehicle traffic and inclement weather; <br />and <br />WHEREAS, Minn. Stat. §469.124 further declares that the actions to assist the <br />implementation of the above development programs authorized by said statute are a public <br />purpose and that the execution and financing of these programs are a public purpose; and <br />WHEREAS, the City, pursuant to Minn. Stat. §469.126, has the authority to acquire <br />land by eminent domain within its Development Districts; and <br />WHEREAS, the City has authority to acquire real property for public purposes by <br />eminent domain pursuant to Minn. Stat. Chapter 117 and pursuant to its City Charter; and <br />WHEREAS, the City has the right to acquire the real property prior to the filing of an <br />award by the Court appointed commissioners, pursuant to Minn. Stat. §117.011 and §117.042; <br />and <br />WHEREAS, the City finds and declares that it is in the public interest to acquire title to <br />and_possession of the real property prior to the filing of an award by the court appointed <br />commissioners; and <br />WHEREAS, the real property which needs to be acquired for the industrial park <br />purposes described above is legally described as follows <br />That part of Lot 1, Auditors Subdivision Number 30, described as follows: <br />Commencing at a point on the east line of said Lot a distance 1,295 feet south of <br />the northeast corner thereof; thence north 67° 47' west a distance of 712.89 feet; <br />thence north and parallel to the east line of said Lot 1 a distance of 419.09 feet; <br />thence north 89° 27' west a distance of 308.19 feet; thence due north a distance of <br />150 feet; thence north 88° 05' 35" west a distance of 307.50 feet; thence south <br />along the westerly right -of -way of Sunfish Lake Boulevard a distance of 807.43 <br />feet to the point of beginning, all in Anoka County, Minnesota, subject to <br />easements of record (one of which is 66 foot wide(N /S) by 307.50 foot long <br />(E /W) driveway easement over the north 66 feet of the east 307.50 feet of the <br />subject property in favor of the City of Ramsey); <br />(The "Subject Property:); and <br />WHEREAS, the Anoka County PIN's for the various parcels are as follows: <br />34- 32 -25 -11 -0018; <br />34- 32 -25 -11 -0019; and <br />34- 32 -25 -11 -0023 <br />Resolution #01 -01 -007 <br />Page 2 of 4 <br />
