• WHEREAS, the property owner of the Subject Property has been identified by the City <br />as follows: <br />• <br />T & G Land Inc. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That in order to carry out the purposes and objectives described above it is necessary to <br />acquire the Subject Property. <br />2. That the acquisition of the Subject Property by exercise of eminent domain in the mariner <br />provided by Minnesota Statute Chapter 117 serves a public interest and is deemed to be <br />necessary. <br />3. That the City deems it necessary for the reasons set forth above to proceed without delay <br />under Minn. Stat. §117.042 to pay to the owners or into court a sum of money to serve as <br />compensation to the owners of the Subject Property, which amount shall be equal to <br />Petitioner's approved appraisal of value as determined by the City. <br />4. That the City Administrator is hereby directed to acquire the Subject Property in <br />accordance with Minnesota Statutes. The City Administrator is authorized to negotiate <br />and represent the City of Ramsey in all proceedings. <br />5. That if the Subject Property cannot be acquired by direct negotiation, it shall be acquired <br />by eminent domain. <br />6. That the City Council hereby authorizes acquisition of the Subject Property by eminent <br />domain and to take title and possession of that land prior to filing of an award by the <br />Court Appointed Commissioners pursuant to Minn. Stat. §117.011 and § 117.042. <br />7. That the City Attorney is authorized to file the necessary petition therefore, and to <br />prosecute such action to a successful conclusion or until it is abandoned, dismissed or <br />terminated by the City or Court. <br />8. That the City Administrator is authorized to expend necessary funds for appraisals of <br />Subject Property. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Zimmerman.
