( "Subject Property") This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The conditions of this permit are as follows: 1. This permit shall expire on January 30, 2004. 2. All equipment used for grading and hauling operations shall be maintained and operated in such a manner to minimize noise, dust, and vibrations adversely affecting surrounding properties. All equipment shall be kept in good repair. Failed equipment and rubbish shall be removed from the worksite regularly. 3. All worksites shall be properly safeguarded to prevent the general public from depositing garbage or other refuse on the worksite. 4. Existing tree and groundcover shall be preserved to the extent feasible. 5. Grading operations shall be conducted in such a manner to minimize interference with the surface water drainage outside the boundaries of the operation. 6. Fencing may be ordered by the City Council or City Engineer anytime the permit is in force and shall be installed within 24 hours of written notice. 7. All access roads to and from the Subject Property , shall be maintained in order to minimize dust. 8. The maximum slope other than the working face shall be sloped on all sides no steeper than a rate of 2 foot horizontal to 1 foot vertical. In no case shall the slope of the working face be left unattended with a slope greater than 3 feet horizontal to 1 foot vertical. When mining operations are anticipated to be discontinued for an interval greater than one working day, the slopes shall be flattened to a grade no steeper than 4 feet horizontal to 1 foot vertical. 9. No grading operation shall be conducted closer than 30 feet to.the right of way line of any existing or platted street, road or right of way. 10. Prior to commencing any grading operations, a cash escrow or letter of credit approved as to form by the City in the amount of Ten Thousand Dollars ($10,000.00) shall be deposited with the City.
