The haul route for the excavated material will be as follows: Between Lots 21 and 22 of <br />the proposed plat of St. Andrews Addition; then across the golf course property to the <br />northern boundary of the railroad right -of -way; then east to 153" Avenue N.W. and then <br />onto T.H. #10. Approximately 34,000 cubic yards of this material may be hauled <br />eastward down 153" Avenue N.W. for the construction of 153" Avenue N.W. /155 <br />Avenue N.W., or onto property lying south of 153 " Avenue N.W. within the Northfork <br />P.U.D. Trucks shall be required to add a sufficient number of axles when travel on roads <br />constructed to less than 9 -ton standards is required to meet a 7 ton per axle road. <br />20. All grading operations shall be conducted between 7:00 a.m. and 7:00 p.m. on weekdays <br />only unless otherwise specifically approved by the City Administrator and/or his <br />designee. <br />21. The amount of dust or other particulate matter caused by the mining operation shall not <br />exceed the standards established by the Minnesota Pollution Control Agency. No <br />operation shall be allowed when wind gusts exceed 30 miles per hour. <br />22. All operations shall comply with all applicable Minnesota Pollution Control Agency <br />regulations and Federal and Environmental Protection Agency regulations for the <br />protection of water quality. <br />23. Alternative haul roads are subject to the approval of the City Engineer. <br />24. While hauling operations are in progress, the permit holder shall maintain the haul road in <br />a condition satisfactory to the City Engineer. When hauling operations are completed, <br />the permit holder shall either restore that haul road to a condition at least equal to that <br />which existed at the time the hauling operations were started, or compensate the local <br />road authority in an amount satisfactory to that road authority and concurred in by the <br />City Engineer for the restoration of that haul road. The City Engineer will then accept <br />such restoration or concur in such financial settlement for the restoration of the haul road <br />in writing and such acceptance will relieve the permit holder of any additional obligation <br />in connection with the restoration of the haul roads. If the permit holder fails or refuses <br />to perform haul road restoration or to make satisfactory financial settlement for such <br />restoration, the City will cause the restoration work to be done and require reimbursement <br />from the financial guarantee required herein. <br />The motion for adoption of the foregoing resolution was duly seconded by Councilmember <br />Anderson and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Gamec <br />Councilmember Zimmerman <br />Councilmember Anderson <br />Councilmember Hendriksen <br />Councilmember Kurak <br />and the following voted against the same <br />None <br />and the following abstained <br />None <br />
