• Councilmember Kurak introduced the following resolution and moved for its adoption: <br />• <br />RESOLUTION #01 -02 -145 <br />A RESOLUTION ADOPTING FINDING OF FACT #0547 RELATING TO A REQUEST <br />FROM THERESA AND MARK DAHLHEIMER FOR A CONDITIONAL USE PERMIT <br />TO MAINTAIN FOUR HORSES ON PROPERTY THAT CONTAINS 2.5 ACRES OF <br />OWNED AND 4 ACRES OF LEASED LAND. <br />WHEREAS, the City of Ramsey received an application from Theresa and Mark <br />Dahlheimer for a conditional use permit to maintain four horses on 2.5 -acres of owned land and <br />4 -acres of leased property. The property is generally known as 8820 181s Avenue NW and <br />legally described as follows: <br />The North 363 feet of East 300 feet of Northeast quarter of Northeast quarter of <br />Section 6, Township 32, Range 25, except road subject to easement of record, <br />Anoka County, Minnesota <br />(the "Subject Property "). <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br />1. That on January 8, 2001, Theresa and Mark Dahlheimer, hereinafter referred to as the <br />"Applicants ", properly applied for a conditional use permit to maintain four horses on less <br />than the required acreage. <br />2. That the Applicants appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on February 6, 2001, and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br />3. That the City received a complaint on the Subject Property on February 28, 2000 regarding <br />the number of horses being maintained on the Subject Property. <br />4. That the Subject Property and surrounding parcels are zoned R -1R Rural Residential. <br />5. That the Subject Property is approximately 2.5 acres in size. <br />6. That the Applicants are renting approximately four (4) acres from Greg Matuseski, an <br />adjacent neighbor to the west of the Subject Property. The leased four acres consists of the <br />southern most portion of Mr. Matuseski's 10 -acre parcel. <br />7. That the Applicants have access to approximately 6.5 acres for the maintenance of horses. <br />
