•
8. That Section 5.09.05 (Horses) of the Ramsey City Code allows two horses on property that is
less than three acres in size with the issuance of a Conditional Use Permit.
9. That Section 5.09.05 (Horses) does not address how leased property affects the number of
horses a property owner is permitted to maintain.
10. That if the Applicants owned the entire 6.5 acres they would be allowed to maintain a total of
nine (9) horses.
11. That the Applicant is proposing to maintain a maximum of four (4) horses on property that
contains 2.5 -acres of owned land and 4 acres of leased property.
12. That a fenced path connects the Subject Property and the leased pasture area in order to allow
the horses to roam between the two properties.
13. That the Applicants have stated that the manure production is dispersed to surrounding
neighbors and spread on the owned and leased land.
14. That the Subject Property contains a 30 -foot by 55 -foot (1,650 square foot) barn and is
located approximately 64 -feet from the nearest property line.
15. That if granted, the conditional use permit is an attempt to gain control of a non - conforming
situation that has existed since 1984 and shall not be deemed a precedent to allow leased
acreage to count as acreage towards the number of permitted horses a property owner can
maintain.
16. That the proposed use will not adversely impact traffic in the area.
17. That the proposed use will not be unduly dangerous or otherwise detrimental to persons
residing or working in the vicinity of the use or to the public welfare.
18. That the proposed use will not substantially adversely impair the use, enjoyment, or market
value of any surrounding property.
19. That the proposed use will not be hazardous to existing or future neighboring uses.
20. That the proposed use will be served adequately by public facilities and services such as
highways and streets.
21. That the proposed use will not create excessive additional requirements at public cost for
public facilities and services, and it will not be detrimental to the economic welfare of the
community.
RESOLUTION #01 -02 -145
