Town of <br />Hampden, 2000 ME 179, 760 A.2d 257 (Me. 2000). <br />Case Note: <br />The Operator also contended that the City Ordinance: was void for vagueness; was in- <br />consistent with the City's comprehensive plan; violated the Operator's equal protec- <br />tion rights; and violated the Commerce Clause of the United States Constitution. The <br />court held that the Ordinance: was not void for vagueness; was not inconsistent with <br />the City's comprehensive plan; and did not violate the Operator's equal protection <br />rights. As to the Commerce Clause claim, the court held that fact issues precluded <br />summary judgment on that claim. Specifically, the court could not determine whether <br />the Ordinance discriminated against interstate commerce in violation of the Com- <br />merce Clause because it found genuine issues of material fact existed as to the pri- <br />mary effect and primary purpose" of the Ordinance. <br />Zoning News from Around the <br />Nation <br />CALIFORNIA <br />Recently introduced Senate Bill 827 would exempt housing projects within <br />a 1/2 mile radius of a major transit stop or a 1/4 mile radius of a high -quality <br />transit corridor from various municipal zoning requirements, "including <br />maximum controls on residential density or floor area ratio, minimum <br />automobile parking requirements, design standards that restrict the applicant's <br />ability to construct the maximum number of units consistent with any ap- <br />plicable building code, and maximum height limitations, as provided." <br />Source: California Legislative Information; https://leginfo.legislature.ca. <br />gov <br />MASSACHUSETTS <br />With a goal of closing the gap between housing supply and housing <br />demand, Governor Baker has proposed a bill that would allow municipal zon- <br />ing ordinances that would "foster the creation of housing" to pass with a <br />simple majority vote rather than the currently required two-thirds supermajor- <br />ity vote. <br />Source: South Coast Today; www.southcoasttoday.com <br />© 2018 Thomson Reuters 11 <br />
