Case #1: <br /> <br />Adopt Ordinance to Vacate Drainage and Utility Easement in Northfork <br />Oaks Third Addition: Case of Anthony Moulder <br /> <br />Community Development Director Frolik stated that Mr. Moulder, who resides at 16271 Royal <br />Road (Lot 4, Block 3, Northfork Oaks Third Addition), applied for an administrative subdivision <br />to acquire a portion of his neighbor's property to the south (Lot 3, Block 3, Northfork Oaks Third <br />Addition). This acquisition enables Mr. Moulder to comply with the side yard setback <br />requirement for accessory structures. To accommodate this acquisition, the existing drainage and <br />utility easements along the common property line must be vacated. City Staff is taking steps to <br />obtain drainage and utility easements along the new common property line. On October 22, <br />2002, City Council introduced an ordinance to vacate drainage and utility easements contained <br />within portions of Lots 3 and 4, Block 3, Northfork Oaks Third Addition. These areas o£Lots 3 <br />and 4 have been acquired by Mr. Moulder to ensure he is in compliance with side yard setback <br />requirements for accessory structures. In accordance with the City Charter, the ordinance was <br />eligible for adoption. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Hendriksen, to adopt Ordinance <br />#02-30 to vacate the drainage and utility easements on Lots 3 and 4, Block 3, Northfork Oaks <br />Third Addition. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Councilmember Hendriksen aye <br />Councilmember Anderson aye <br />Councilmember Kurak aye <br />Councilmember Zimmerman absent <br />Mayor Gamec aye <br /> <br />Motion carried. <br /> <br />Case #2: <br /> <br />ReqUest to Vacate Public <br />Northfork GC, LLC <br /> <br />Street and. Utility Easement: "Case. of Links at <br /> <br />Community Development Director Frolik stated that in researching-the easement it was <br />determined that the easement had been vacated in 1991 so no action was required. <br /> <br />Case #4: <br /> <br />Request for Preliminary Plat Review of Rivenwick 3ra Addition: Case of <br />Turtle Moon, Inc. <br /> <br />Associate Planner Wald stated that Turtle Moon Inc. has applied for preliminary plat review of a <br />townhome development. The property is generally located south of Riverdale Drive and north of <br />the existing Rivenwick urban residential development. The project area is approximately 19.46 <br />acres in size.
