Councilmember Anderson requested that the issue be placed on the Council agenda as an update <br />item so that they make sure the issue is being addressed. <br /> <br />Councilmember Hendriksen stated that he opposed the plant many years ago as a citizen because <br />he could smell it driving down Highway #10. He also opposed the re-issuance of the conditional <br />use permit as a Councilmember. He stated that the City needs to have someone make a <br />determination if there is a smell and do so in a way that will be credible in a court of law if the <br />City ultimately has to revoke the permit. The applicant stood before the Council indicating that <br />if the City did not renew the conditional use permit they would take legal action. The City needs <br />to have proper documentation of the complaints. <br /> <br />City Attorney Goodrich stated that the MPCA does have technology to detect odors and <br />suggested that the City recommend that the MPCA address those issues. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Kurak, to direct the City <br />Attorney to bring back at the next regular City Council meeting a course of action that will allow <br />the Council to document the findings at a time when they have a report of the odorous condition <br />to either confirm or deny that they exist. <br /> <br />Motion carded. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Kurak, and <br />Anderson. Voting No: None. Absent: CouncilmemberZimmerman. <br /> <br />Jim Gilbertson stated that he watched the segment on television .regarding lock boxes on <br />businesses and the trouble they are causing. He inquired if anyone from the City has responded <br />to the business owners of Ramsey since the City requires the lock boxes. <br /> <br />Mayor Gamec replied that with pending legal action he would not make a statement at this time. <br /> <br />Mr. Gilbertson stated that the lock boxes are currently on local businesses putting businesses in <br />jeopardy and the City is going to wait for legal action before they do anything. <br /> <br />Mayor Gamec replied that the Ramsey Fire Department has notified over 80 businesses because <br />of one business making a mistake. <br /> <br />Mr. Gilbertson stated that businesses in Ramsey were ordered to put the lock boxes on by the <br />City and now they have jeopardized everyone's business in town. <br /> <br />Winslow Holasek, Andover Boulevard, Andover, stated that at the last Council meeting he had <br />requested information from the Council regarding the information they received from the City <br />Administrator pertaining to the City acquiring their property. He stated that he has not yet <br />received that information. <br /> <br />Mayor Gamec requested that staff research that information for the next meeting. <br /> <br />City Council/November 12, 2002 <br /> Page 3 of 22 <br /> <br /> <br />
