City Attorney Goodrich replied that there is no legal notice timeframe for a moratorium, but <br />noted that the ordinance cannot become effective for six weeks. <br /> <br />Ms. Kurak stated that it was common courtesy for the City to let people know what is going to <br />happen with their property. She inquired as to who would be completing the proposed study in <br />the resolution and who will be paying for the study. <br /> <br />City Attorney Goodrich replied that it was his understanding that MnDOT would be paying for <br />the study. <br /> <br />Ms. Kurak inquired as to how long the study would take. <br /> <br />Mr. Pafko replied that he could not answer that question tonight. He explained that that is why <br />MnDOT would like to meet with City staff immediately and work out a schedule. <br /> <br />Ms. Kurak inquired as to what they would be looking at with an environmental study. <br /> <br />Mr. Pafko explained that the State Environmental Rules require MnDOT to not make a final <br />decision on a plan until they complete an environmental study. At this time they don't know <br />what level of a study will be required. <br /> <br />Ms. Kurak inquired if the environmental impact study is done to identify that the road can be <br />moved. She stated that the City could be facing a lot of lawsuits over this issue. She thought <br />that the moratorium was premature when they don't know what is going to happen. <br /> <br />Mayor Gamec inquired if Ms. Kurak was in favor of the City paying the entire tax bill if they <br />have to condemn the property. <br /> <br />Ms. Kurak stated that she is worried that the City might have to pick up the tab in the future. <br /> <br />Jeff Johnson, Attorney representing Mr. and Mrs. Deal, stated that he was present to address <br />issues regarding his client's opposition. He inquired if the moratorium was being adopted under <br />State Statute 462355 and if it would be in place for one year. <br /> <br />City Attorney Goodrich replied yes. <br /> <br />Mr. Johnson stated that there is a one-year limit on the moratorium with the potential of being <br />extended for 18 months. He inquired if the City of Ramsey would be conducting any studies. <br /> <br />City Attorney Goodrich replied that the Council will be considering adoption of a resolution <br />authorizing a study to determine the feasibility of the City adopting an official map for certain <br />property in the Highway #10 corridor. <br /> <br />City Council/November 12, 2002 <br /> Page 7 of 22 <br /> <br /> <br />
