City Attorney Goodrich replied yes. <br /> <br />Councilmember Hendriksen stated that if the initial period is not to exceed one year and you can <br />extend it for up to 18 months, that is 30 months. If they start at 90 days and they can extend up <br />to 18 months he believed the City Attorney has taken the position that the maximum time would <br />be less than 30 months. <br /> <br />City Attorney Goodrich replied that that was not the case. <br /> <br />Councilmember Hendriksen replied that he believed that the City Attorney had ruled differently <br />in the past. <br /> <br />City Attorney Goodrich stated that the Council needed to discuss the parameters of the <br />moratorium. <br /> <br />Mayor Gamec stated that he would have no problem with improvements being done on an <br />existing structure, but he would not agree to any 'new construction. <br /> <br />Community Development Director Frolik inquired if any project that has already received site <br />plan approval would be able to move forward with their project. <br /> <br />Mayor Gamec replied that that was correct. <br /> <br />Councilmember Zimmerman agreed that improvements on existing structures should be allowed, <br />but not new construction. <br /> <br />Councilmember Hendriksen stated that he wants to see the moratorium be in place for 12 months <br />and then they reduce it if appropriate. ~ <br /> <br />Consensus was to place a 12,month moratorium on the property, north of Highway #10 and south <br />of the railroad tracks within the CitY limits. <br /> <br />City Attorney Goodrich stated that the moratorium would prohibit new subdivision, rezoning, <br />new building construction, and any building permits, unless addressed as an exception. <br /> <br />Mayor Gamec stated that he did not think that property owners should be required to do <br />improvements required 'by the City during the moratorium. <br /> <br />Community Development Director Frolik inquired if all the businesses that are currently <br />operating on dirt can continue to do so during the moratorium. <br /> <br />Mayor Gamec replied that that was correct. <br /> <br />Councilmember Zimmerman agreed with Mayor Gamec. <br /> <br />City Council/October 22, 2002 <br /> Page 14 of 37 <br /> <br /> <br />
