City Engineer Jankowski replied no.

Councilmember Hendriksen inquired as to why the issue was brought forward.

Community Development Director Frolik explained that the golf course is under new ownership
and they are trying to clear up some of the issues on the property.

Councilmember Hendriksen stated that the easement is in the area where Highway #10 goes back
to the railroad tracks. He inquired if staff was aware of what the final disposition of the overpass
will be if it will be Alpine Drive or Jarvis Street.

Principal City Engineer Olson replied that the City formally requested that Alpine Drive be an
interchange and the State has put that information in as an official comment for approval.

Councilmember Hendriksen stated that the easement would be a location between Alpine Drive
and Jarvis Street, which could be the resolution to the problem without having to acquire land.

Councilmember Zimmerman stated that at a minimum if the City paid for the easement they
should have that money coming back.

Mayor Gamec requested that staff reSearch that information and bring it back to the Council.

Motion by Councilmember Zimmerman, seconded by Councilmember Hendriksen, to table
action.

Motion carded. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Hendriksen,
Anderson, and Kurak. Voting No: None.

Case #4:

Request for a Conditional Use Permit to Exceed Accessory Building Size
Restrictions': Case of David and Sandra Shappell

Applicant withdrew their application.

Case #5:

Request for a Conditional Use Permit to Exceed Accessory Building Size
Restrictions: Case of Cindi and Michael Heying

Community Development Director Frolik stated that the City received an application from Cindi
and Michael Heying for a conditional use permit to exceed the accessory building size
restrictions established in City Code on the property located at 17211 Willemite Street NW.
