Mayor Gamec called the public hearing to order at 9:02 p.m.

Presentation

Community Development Director Frolik stated that The Links at Northfork GC, LLC applied
for a vacation of public street and utility easements on Lot 10, Block 3 of Northfork Links
Addition. The public street and utility easement was put in place when Northfork Links
Addition was platted, in anticipation of the extension of 153rd Avenue. The street was
subsequently extended in a different location than shown on the Northfork Links plat; therefore,
the City no longer requires public street and utility easements as shown on the plat. City staff
recommended approval of the request for easement vacation.

Citizen Input

There was none.

Motion by Councilmember Kurak, seconded by Councilmember Hendriksen, to close the public
hearing.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Hendriksen, Anderson,
and Zimmerman. Voting No: None.

The public hearing closed at 9:03 p.m.

Council Business

Councilmember Zimmerman inquired if the City paid for the easement.

Community Development Director Frolik replied that the City probably received the easement as
part of the platting process for Northfork Links.

City Attorney Goodrich inquired as to who drafted the easement document.

City Engineer Jankowski replied that City Attorney Goodrich drafted the document.

City Attorney Goodrich replied that the City probably paid for the easement.

Councilmember Zimmerman inquired if there was any reason why they would need the road in a
different location.

City Engineer Jankowski replied that the easement has been in place since 1986.

Councilmember Zimmerman inquired if the Council needed to take action tonight.

City Council/October 22, 2002
