Councilmember Zimmerman inquired as to why there is such a high rate of failure within the <br />City of Ramsey. <br /> <br />Sergeant Way replied that he did not think that the City of Ramsey's rate of failure was any <br />higher than other communities. He stated that if they continue with the compliance checks, there <br />will ultimately be fewer violations, which is their goal. <br /> <br />Councilmember Zimmerman suggested that possibly the problem is that the City is not doing <br />anything about the violations. <br /> <br />Sergeant Way replied that that is why the Police Department would like to tighten up the <br />ordinance. Currently all violations have to go before the Council for action. The Police <br />Department would like to have the violations established in the ordinance so that they can <br />address the issues in a more timely matter. <br /> <br />Councilmember Hendriksen inquired if on the fourth offense would the license be revoked and <br />never be reinstated with the proposed changes. <br /> <br />Sergeant Way replied that typically if something is revoked they don't get it back. <br /> <br />Councilmember Hendriksen stated that that should be stated clearly in the ordinance. <br /> <br />Mayor Gamec stated that if someone has four violations in a 12-month period, then the license <br />should be revoked permanently. <br /> <br />Councilmember Hendriksen suggested that the City Attorney review the language being <br />proposed. He stated that he could imagine a revocation where a person could reapply for the <br />license at some point and a revocation where the ownership never gets the license back again. <br /> <br />Sergeant Way explained that the way the policy is currently, is that any violation has to come <br />before the Council for action. <br /> <br />Mayor Gamec replied that he did not think that that should be the situation. <br /> <br />Councilmember Kurak agreed. She inquired if the Police Department conducts four compliance <br />checks in a year on each business. <br /> <br />Sergeant Way replied that the Police Department conducts at least two compliance checks a year <br />and if there is a problem with a business they will do more frequent visits. <br /> <br />Councilmember Hendriksen stated that current ordinance regarding off-sale liquor states that the <br />Council shall revoke and with on-sale it states that the Council may revoke.
