He noted that he <br />would work with the City Attorney on drafting the appropriate language changes. <br /> <br />Councilmember Anderson inquired if they wanted to state that on the fourth violation it would be <br />a permanent revocation. <br /> <br />Sergeant Way replied that he would discuss that further with the City Attorney. <br /> <br />Councilmember Zimmerman suggested that maybe the third offense should be a 30-day <br />suspension rather than 3 days. <br /> <br />Councilmember Kurak recommended a 30-day suspension on the second violation, a one-year <br />suspension on the third violation, and permanent revocation on the fourth violation. <br /> <br />Consensus of the Council was that the penalties should be as follows: <br /> <br /> First Violation-S500.00 civil penalty for the licensee and written notification of the violation. <br /> Second Violation-A five-day suspension. <br />· Third Violation-A 30 day suspension. <br /> Fourth Violation-Revocation of license. <br /> <br />Councilmember Hendriksen requested that staff discuss two issues with the City Attorney: one <br />was how do they handle a violation to a corporate business that might have multiple chains <br />throughout the City and, secondly the City is giving training to the establishment, but the City is <br />not receiving any guarantee that the clerk has been given any training. <br /> <br />Sergeant Way replied that the license holder has to sign off that their clerks have received the <br />appropriate training. <br /> <br />Councilmember Hendriksen inquired if the people that are selling the product are made aware <br />that they will be charged criminally if they sell to a minor. <br /> <br />Sergeant Way replied yes. <br /> <br />City Council/October 22, 2002 <br /> Page 3 of 6 <br /> <br /> <br />
