not necessarily see that as a bad thing, but that they should have the language right so that they
don't have a subjective decision every time.

Sergeant Way inquired if the proposed changes seemed acceptable.

Consensus was yes.

Councilmember Hendriksen inquired as to what the criminal charge is when someone sells to a
minor.

Sergeant Way replied that the person would be charged with a misdemeanor. He noted that he
would work with the City Attorney on drafting the appropriate language changes.

Councilmember Anderson inquired if they wanted to state that on the fourth violation it would be
a permanent revocation.

Sergeant Way replied that he would discuss that further with the City Attorney.

Councilmember Zimmerman suggested that maybe the third offense should be a 30-day
suspension rather than 3 days.

Councilmember Kurak recommended a 30-day suspension on the second violation, a one-year
suspension on the third violation, and permanent revocation on the fourth violation.

Consensus of the Council was that the penalties should be as follows:

First Violation-S500.00 civil penalty for the licensee and written notification of the violation.
Second Violation-A five-day suspension.
· Third Violation-A 30 day suspension.
Fourth Violation-Revocation of license.

Councilmember Hendriksen requested that staff discuss two issues with the City Attorney: one
was how do they handle a violation to a corporate business that might have multiple chains
throughout the City and, secondly the City is giving training to the establishment, but the City is
not receiving any guarantee that the clerk has been given any training.

Sergeant Way replied that the license holder has to sign off that their clerks have received the
appropriate training.

Councilmember Hendriksen inquired if the people that are selling the product are made aware
that they will be charged criminally if they sell to a minor.

Sergeant Way replied yes.

City Council/October 22, 2002
