Mr. Tim Gladhill <br /> April 5, 2018 <br /> Page 2 <br /> • Additional traffic generated by the commercial equipment leaving and returning to <br /> the Longfield property each day. <br /> • Concerns that the operation of heavy equipment on 177t Avenue NW will cause <br /> premature deterioration of the roadway, which presumably was not constructed to <br /> withstand the loads the heavy, commercial equipment will place upon it. <br /> • Parking of trucks and equipment along the roadway, or within the cul-de-sac of 177th <br /> Avenue NW, often impeding my clients' access to their own property. <br /> • Aggressive driving and high - speed operation of the vehicles, both personal trucks <br /> and the commercial vehicles, either coming to or exiting the Longfield property. <br /> It appears from the Notice of Public Hearing that Longfield's application is being analyzed <br /> and considered by the City in accordance with the Conditional Use Permit procedures established <br /> by Ramsey's Code Section 117-51. Subpart (a) of that Code section states that the City shall <br /> determine when considering such applications, the "suitability of certain designated uses upon the <br /> general welfare,public health, and safety." Subpart (b)(7) of Code Section 117-51 mandates that <br /> the City "shall consider possible adverse effects of the proposed conditional use. This <br /> consideration shall be based upon (but not limited to) the following factors: ... (b) the nature of <br /> adjoining land or buildings... (e) whether or not this use will substantially adversely impair the <br /> use, enjoyment or market value of any surrounding property ...(k) whether the proposed uses will <br /> involve uses, activities, processes, materials and equipment and conditions of operation that will <br /> be detrimental to any persons, property or the general welfare by reason of excessive production <br /> of traffic, noise, smoke,fumes, glare or odors.... " <br /> It is the Kvetons' position that Longfield's application to operate his landscape and concrete <br /> business on his property pursuant to a Home Occupation Permit should be denied because the <br /> imposition of a commercial activity that utilizes several commercial vehicles and heavy equipment <br /> would not be harmonious with the character of the residential neighborhood and would significantly <br /> impair the use and enjoyment of my clients' property and those of their other neighbors located in <br /> close proximity to this proposed commercial activity. While Longfield's application indicates he <br /> intends to construct a 60X78 foot building to store the equipment and vehicles used in his <br /> commercial business, nevertheless sooner or later those commercial vehicles and equipment will <br /> be leaving and returning to the Longfield property at least twice a day, every day the business is <br /> being operated. Storing the vehicles and equipment in the proposed building will not alleviate most <br /> of the concerns specified above, such as the additional traffic, fumes and noise that is produced by <br /> such commercial activity and the premature deterioration to 177th Avenue NW that will inevitably <br /> result from the operation of large, heavy commercial vehicles and equipment over and across the <br /> road several times a day. <br /> Problems aroseever since Longfield began operating his business at his property, resulting <br /> in several calls to the Ramsey Police Department.
