Capstone I taw
Protecting What You Value Most
April 5,2018
By Email
Mr. Tim Gladhill j
Community Development Department
City of Ramsey
7550 Sunwood Dr.NW
Ramsey, MN 55303
Email:tgladhill@cityoframsey.com
Re: Home Occupation at 5751 177th Ave.NW., Resolution 2018-066
Mr. Gladhill:
Regarding the Findings of Fact section, I have the following comments:
Paragraph 14 seems to misstate the traffic limitations imposed by Code § 117-351. The Code
does not limit vehicular traffic to 2 vehicles per hour. Rather, that section defines "excessive
vehicular traffic"for the purpose of a home occupation as in excess of any combination of eight
round trips, not including one round trip per eligible employee. Code 117-351(1)(i).
Regarding the permit conditions sections, we request one minor modifications as follows:
Regarding Paragraph 2, Mr. Longfield requests that he be given until March 2019 toconstruct
the accessory building to house his vehicles and equipment. While Mr. Longfield will endeavor
to complete the building by October 2018,the construction period will unfortunately align with
the busy landscaping season. Therefore,Mr. Longfield requests some leniency in the completion
deadline.
Finally, in the interest of transparency,Mr.Longfield wishes to make clear that the same
individuals who are employees of his landscaping business may also assist with the construction
of the accessory structure. This construction work would not be related to the Home Occupation
and would not be any different in character than if Mr. Longfield hired an outside construction
company to do the work.
Reg
4.9
Rob Shainess
Attorney at Law
rob@capstonelaw.com
Phone 612-548-1604// Fax 952-314-9616 120 South Sixth Street, Suite 1720
www.capstonelaw.com Minneapolis, MN 55402
