City Attorney Goodrich indicated the <br />ten percent concept is not well drafted "at this point, and he wOuld like the authority to improve <br />the language. Mr. McDonald sugge~ed a two-hour time frame be allowed, rather than 10 <br />percent of the hours, which is a little.'short_. <br /> <br />Motion on the floor amended by Coun~ilmember. Cook, seconded by Councilmember Kurak, to <br />approve the request for Ramdance, iLEC for a Conditional Use Permit for a drive-thru feature <br />on the Pond Building, based on the findings of fact, and adopt Resolution #04-12-388 declaring <br />terms of ~ame, with the :following additional conditions, and With authority .for the City <br />Attorney and City Planner to improve the langUage: <br /> · For Coffee shop type uses, whiqh require minimal drive up use and will not'include fast <br /> food restaurants. <br /> · The traffic pattern forthe use sfiallbe designed to prohibit the queuing of vehicles to no <br /> more than four vehicles from the menu station and back, except the queuing of more <br /> than four vehicles shall be permittedduring.20 percent of the establishment's operating <br /> hours. <br /> <br />Councilrnember Kurak stated the intent of the Council is clear in regards to the queuing. <br /> <br />Motion carried. Voting Yes: Mayor~Pro Tem Zimmerman, Councilmembers Cook, Kurak, <br />Elvig, and Pearson. Voting No: None. Absent: Mayor Gamec and Councilmember <br />Strommen. <br /> <br />Mayor Pro Tern Zimmerman requested thiSTbe presented to the Planning Commission for <br />review. <br /> <br />Case #10: ReqUest for PreliminarYSite Plan Approval of the Pond Building in <br /> Ramsey ToWn Center 3ra Addition; Case of Ramdanee, LLC <br /> <br />Community Development Direet°r~ Fro!ik indicated Ramdance, LLC has submitted a <br />preliminary site plan for apProval of the fourth and fina! building in Phase 1 of the Ramsey <br />Town Center 3rd Addition, Lot 1. The~ structures previously approved for the Phase 1 include <br />the Cobom's grocery store, the Comer ~retail building in the northeast comer of the site, and the <br />Gateway retail building in'the northwes3 comer of the site. This fourth building backs up to the <br />pond adjacent to Armstrong Boulevard, and: will be referenced as the Pond Building. The site <br />plan for the Pond Building generally Conforms to the Town Center Development Guidelines. <br />The west side of the building includes an outdoor dining area that- overlooks the landscaped <br />pond.
