Assistant CommUnity DeVelopment, Director. Trudgeon explained the combination of
townhomes and single-family lots in the n0rthem portion of the plat will need to' be processed
as a Planned Unit Development. ThelPr°p°Sed-development will also need to go through site
plan review, most likely at the preliminary ~plat stage. The revised sketch plan is proposing to
construct a combination of public and~riVate streets-throughout the development, similar to the
streets that were approved with the firs~itWo phases of Town Center Gardens. The revised
sketch plan shows i148'h Avenue being broUght to the western boundary' of the plat. This is in
compliance with City Code, Which r~uires streets to be broUght to the edge of the plat to
facilitate development on adjacent parcels, ishould it occur. He explained a .temporary cul-de-
sac will need to be provided :on 147th'i~aneNW; this street also exceeds the maximum cul-de-
sac length as outlined in City Code. 3, variance will be required for this length of cul-de-sac.
Staff finds this plan generally acceptable and recommends the plan move 'ahead into the
platting process.

Councilmember Cook asked if lthis could be accomplished under a PUD, rather than an
amendment to the Comprehensi'OePl.an and zoning change. He stated he would hate to see
commercial property coming :in there down the line because it is zoned multi-use.

Assistant Community Devel0pm ,ent Director Trudgeon replied he is not sure if the codes allow
for increasing density through :just !a simple PUD process, which might undermine the
Comprehensive Plan procesS. The Sed_~ond thing would be the precedent that would be set. The
north area of this subdivision :will !be:a iPUD because of the single-family homes and
townhomes, and the PUD is. nee. essa~: to inCrease the density. If the Council would like to
proceed that way he would be hapPY t6 see if it is allowed and confer with the City Attorney.

Councilmember Elvig concurred with Councilmember Cook. He expressed concern that mixed
use opens up a can of worms in the long: term with the possibility of commercial use.

Assistant Community DeveloPment Trudgeon advised the zoningis TC-4a, .which is primarily
residential.

Councilmember Kurak inquired about snow storage.'

Phil Domer, Vice'President of Briglitkeys, Inc., replied there are designated snow removal
areas.

Assistant Community Development Director Trudgeon indicated the City Mil take care of
snow in the public Streets.

Assistant Public Works Director Olson advised the snow from the public street will be moved
within the right-of-way. He noted tl~s is Part of the Phase 2 roadways in Town Center that
have had approval of feasibility study preparation. The roadways directly to the west of this
long cul-de-sac will be moving forward and: will provide the second alternative access to this
subdivision. The alignments of thos~ right-of-ways will be considered when the preliminary
plat comes forward with this subdivisign.

City CoUncil/December 14, 2004
Page 27 of-33

P49
