CASE # <br /> <br /> PUBLIC HEARING <br />REQUEST FOR A VARIANCE TO MINIMUM LOT WIDTH AND <br />LOT AREA IN THE CRITICAL RIVER OVERLAY DISTRICT;' <br />CASE OF DARRELL ANDERSON <br /> By: Chris Anderson, Zoning and Recycling Coordinator <br /> <br />Background: <br /> <br />The Critical River Overlay District of the Ramsey City Code states that lots that are sub-standard <br />in width and area by today's standards are not eligible for development if it is under the same <br />ownership as one of the adjacent parcels, City Code requires a variance to be obtained for lot <br />width and lot area when duo-ownership occurs in order for the lot to be considered buildable. <br /> <br />Donald and Molly Anderson own Lot 1 Block 1 Bowers Mississippi Acres 2nd Addition and Lot <br />33 Bowers Mississippi Acres. Their home is currently on Lot 33 Bowers Mississippi Acres <br />while Lot 1 Block 1 Mississippi Acres 2nd Addition. remains vacant. The Andersons intend to sell <br />both lots to help offset family medical expenses. However, since Lot 1 Block 1 Bowers <br />Mississippi Acres 2~a Addition does not contain a principal dwelling and is Currently owned by <br />the Andersons, it is necessary for them to; obtain a variance to lot width and area to render it a <br />buildable lot. Their son, Darrell Anderson, has applied for this variance on their behalf. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Letter fi'om Applicant <br />c) Letter from DNR <br />d) Aerial layout of property <br />e) Proposed findings of fact <br />f) Proposed variance <br /> <br />Notification: <br /> <br />State statute requires notification of the pub!ic hearing to owners of property within 350 feet of <br />the subject property. <br /> <br />Observations: <br /> <br />The subject properties were platted in 1948 (Loti33 Bowers Mississippi Acres) and 1964 (Lot 1 <br />Block I Bowers Mississippi Acres 2na Addition) with lot widths of '100 feet and are <br />approximately .95 and .97 acres in size, Under today's standards, the minimum lot dimension <br />requirements are 2.5 acres in size and a 200 :foot lot width. <br /> <br />The dno-ownership rule in the Critical River Overlay District came into effect in 1985 and <br />therefore rendered Lot l Block 1 Bowers Mississippi Acres 2na Addition unbuildable. Since the <br />new rules in 1985, the Board of Adjustment has approved several variances to allow for duo- <br />ownership lots to be considered buildable on Bowers Drive. <br /> <br /> <br />
