December 25, 2018 I Volume 12 I Issue 24 Zoning Bulletin <br />the appellate court concluded that the statute did not, onits face, "make a local <br />government's issuance of any and all `permit[s] relating to a special use of property' <br />`legislative action[s],' regardless of the process that was used to make any such <br />decision." The court emphasized it was the decision -making process used by the local <br />entity that determined whether the entity's decision was quasi-judicial or legislative. <br />Here, the court concluded that the Board's decision was a "quasi-judicial" (not legisla- <br />tive) action by a local government resulting in "[t]he grant of a permit relating to a <br />special use of property." (See OCGA § 36-66-3(4)(E).) Under the measure, possession of <br />recreational marijuana is illegal "at K-12 schools or lands owned by the federal <br />government, such as national forests or parks." Local governments must now <br />establish regulations related to the commercial sale of recreational marijuana, <br />and can, among other things, adopt an ordinance to ban marijuana sales or adopt <br />local zoning laws to regulate marijuana businesses. <br />Source: Cadillac News; wwwcadillacnews.com <br />WASHINGTON <br />The City of Olympia has adopted new regulations that "relax restrictions and <br />legalize more types of modest multifamily dwellings citywide."
