Ramsey Town Center. He explained the l~amsey Town Center retail areas have been set up to <br />have the buildings close to the right-Of-waY lines. The zoning code specifically requires most <br />buildings to be within 0 - 5 feet of the front lot line to create a more urban look to the <br />development. Staff is requesting that the Council direct staff to bring forward a policy with the <br />bullet points listed on pages 201 and 202o£the Council's packet as a guideline. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Cook, to ratify the <br />recommendation of the Public WOrks Committee in Case 8 and to direct staff to bring fmwvard a <br />policy regarding right-of-way encroachment as recommended by staff. <br /> <br />Motion carried. Voting Yes: 'Mayor Gamec~ Councilmembers Elvig, Cook, Jeffrey, Olson, <br />Pearson, and Strommen. VotingNo: None. <br /> <br />Mayor Gamec recessed the meeting was recessed at 8:45 p.m. <br /> <br />Mayor Gamec left the meeting at 8:45 p.m: <br /> <br />Mayor Pro Tern EIvig reconvened the meeting at 8:52 p.m. <br /> <br />Mayor Pro Tern Elvig indicated :Shingobe~ Buil~ters would like more discussion of Case No. 3/8 <br />regarding the encroachment procedure for buildings in Ramsey Town Center. <br /> <br />Greg Hayes with Shingobee Builders stated the TC-2 zoning district has been a learning process <br />with the buildings being pushed to the front, In future plans they may want to try to hold the <br />buildings back one foot so they do not get into the setback issues. <br /> <br />Assistant Public Works Director Olson exPlained this site plan is already approved. Shingobee <br />Builders came to staff to inform them there would be an issue with the setbacks that should be <br />looked at. Staff looked at St. Paul and MinneapOlis examples. It appears that the door swing of <br />the first building will encroach approximately i foot, 3 inches into the right-of-way, and there <br />will still be 11 feet between that and the curb line. Even with the door swing the sight distance <br />triangle will still be inet. Staff does not see a problem with this, and they have been working <br />well with Shingobee Builders. <br /> <br />Mt'. Hayes stated Shingobee Builders is looking forward to proceeding with the first phase, and <br />this will help make the next phase run smoQther. <br /> <br />Case/44: Consider Authorization of Development/Purchase Agreement with River's <br /> Bend HOldings CO;, LLC <br /> <br />City Administrator Norman explained this development purchase agreement dates back to <br />January 1980, in a land exchange agreement between the City and Arthur Raudio and Rick <br />Foster. Negotiations began on this current Development/Purchase Agreement in 1999 when the <br />City was in the process of purchasing right-of-way agreements for the TH 47 improvement <br />project that took place in 2001.
