CC Regular Session 4. 11. <br />Meeting Date: 02/12/2019 <br />By: Bruce Westby, Engineering/Public <br />Works <br />Information <br />Title <br />Adopt Resolution #19-053 Accepting Permanent Utility Easement on Lot 1, Block 1, LAZYDAYS Addition <br />Purpose/Background: <br />Purpose: <br />The purpose of this case is to adopt Resolution #19-053 accepting a permanent utility easement on Lot 1, Block 1, <br />LAZYDAYS Addition per the executed Utility Easement Agreement. <br />Background: <br />A condition of Plat approval for the Lot 1, Block 1, LAZYDAYS Addition property was that their new maintenance <br />facility connect to City sewer and water since the property is located within the City's Metropolitan Urban Service <br />Area (MUSA). The maintenance facility is under construction and will include 20 service bays, a waiting area, a <br />parts warehouse, a receiving dock, and office space for approximately 30 staff including service managers and <br />technicians, warehouse staff, and customer service representatives. <br />City Improvement Project #18-14 proposes to extend 18-inch trunk sanitary sewer and 12-inch trunk watermain <br />from the southwest corner of old Armstrong Boulevard and Riverdale Drive along the south side of Riverdale <br />Drive to serve the new maintenance facility. These improvements have sufficient capacity to serve all existing and <br />future development in the area south of Highway 10 and west of Armstrong Boulevard, which is also located within <br />the City's MUSA. <br />While Improvement Project #18-14 was being bid, it was discovered that gas, electric and telecommunications lines <br />were previously installed in the same alignment as our proposed trunk utilities. Since this project is proposed to be <br />completed during winter, impacts to private utilities are problematic as the ground surrounding the private utilities <br />will be frozen making them impossible to relocate without first thawing the ground around them, which would <br />increase the construction schedule and construction costs. The City's trunk utilities were therefore moved south of <br />the private utilities, which will require an additional 10-foot of permanent utility easement along the Lazydays RV <br />site to construct and maintain the trunk utilities in perpetuity. <br />Attached is an executed utility easement agreement dedicating a 10-foot wide strip of permanent utility easement <br />along the Lot 1, Block 1, LAZYDAYS Addition property. The property owner has willingly dedicated this <br />easement via the attached utility easement agreement. Exhibit B of the attached easement agreement includes a <br />legal description for the permanent utility easement and depicts it graphically. <br />Notification: <br />Notifications are not required for this action. <br />Observations/Alternatives: <br />Observations: <br />Accepting the 10-foot wide permanent utility easement along Lazydays RV's site per the attached easement <br />agreement is necessary to allow the trunk utilities to be adequately constructed with City Improvement Project <br />#18-14, and to be properly maintained in perpetuity. This action must be complete before bids are accepted and a <br />construction contract awarded for City Improvement Project #18-14 as included on the regular agenda for this <br />evening's Council meeting. <br />
